A federal appeals court has rejected the Trump administration’s attempt to oust members of two independent federal labor agencies in a pair of back-and-forth cases that will likely set the stage for a showdown at the U.S. Supreme Court and have a profound impact on President Donald Trump’s continued effort to slash the federal workforce.

In a 7-4 vote, the full panel of judges on the U.S. Circuit Court of Appeals for the District of Columbia blocked the president from removing Cathy A. Harris from the Merit Systems Protection Board (MSPB) and Gwynne Wilcox from the National Labor Relations Board (NLRB), reasoning that they were improperly dismissed without cause.

“The government has not demonstrated the requisite ‘strong showing that [it] is likely [to] succeed on the merits’ of these two appeals,” the panel wrote in a three-page per curiam order. “The government likewise has not shown a strong likelihood of success on the merits of its claim that there is no available remedy for Harris or Wilcox, or that allowing the district court’s injunctions to remain in place pending appeal is impermissible.”

Over the weekend, a Justice Department attorney was put on administrative leave after acknowledging in court that he’d never been given a “satisfactory” answer for why the U.S. government couldn’t return a wrongfully deported immigrant from Venezuela who had been residing in Maryland. Now, the 4th Circuit Court of Appeals is scolding the DOJ’s behavior in a new ruling.

In a unanimous decision on Monday, the court denied President Donald Trump’s administration’s efforts to resist returning Kilmar Abrego Garcia to the United States by midnight on Monday, wrote Politico legal reporter Kyle Cheney on X.

J. Harvie Wilkinson III, an appointee of former President Ronald Reagan, was particularly scathing in his reaction to government claims that it could not possibly bring Garcia back to the United States despite acknowledging his wrongful deportation.

“The government rightfully concedes that it was an ‘error’ and a ‘mistake’ to ignore this process,” Wilkinson wrote. “And, if it is truly a mistake, one would also expect the government to do what it can to rectify it. Most of us attempt to undo, to the extent that we can, the mistakes that we have made. But, to the best of my knowledge, the government has not made the attempt here. The facts of this case thus present the potential for a disturbing loophole: namely that the government could whisk individuals to foreign prisons in violation of court orders and then contend, invoking its Article II powers, that it is no longer their custodian, and there is nothing that can be done. It takes no small amount of imagination to understand that this is a path of perfect lawlessness, one that courts cannot condone.”

Reuters: US Marshals were mobilized to warn fired DOJ lawyer over congressional testimony, attorney says

The U.S. Justice Department sent armed U.S. Marshals to deliver a letter warning a fired career pardon attorney about testifying to congressional Democrats, her lawyer said in a letter seen by Reuters on Monday.

“This highly unusual step of directing armed law enforcement officers to the home of a former Department of Justice employee who has engaged in no misconduct, let alone criminal conduct, simply to deliver a letter, is both unprecedented and completely inappropriate,” Michael Bromwich, a lawyer representing fired pardon attorney Liz Oyer, wrote to the Justice Department.’

Oyer has since told various media outlets that her firing came shortly after she declined to recommend restoring gun rights to actor Mel Gibson, a supporter of President Donald Trump.

Deccan Herald: The world suddenly has a plausible alternative to US treasuries

Bond traders will be trying to gauge who blinks first, will it be the Fed or President Trump? If both stick to their current stance every Treasury auction is a landmine which investors will fear stepping in to.

Yields on the benchmark 10-year Treasury have tumbled about 40 basis points this year, briefly pushed below 4% Monday by President Donald Trump’s barrage of tariffs that economists say raise the risk of a recession.

In contrast, comparable rates in both Europe and Japan have gone up. In Germany, the 10-year bund at 2.61% reflects the prospect of a flood of bond issuance as the government ramps up defense spending. Meanwhile, the rate on 10-year Japanese bonds has soared after spending years around zero and is now around 1.25% as investors brace for tighter monetary policy there.

While both are still well below Treasury yields, they’re at levels that makes them look more attractive than Treasuries to European and Japanese investors who hedge their dollar exposure when buying US securities. That might entice investors to shift allocations to their home markets, where the policy outlook appears more stable.

A bodyguard in Secretary of State Marco Rubio’s security detail was arrested after “behaving erratically” at a hotel in Brussels and fighting with police officers in the Belgian capital, according to reports.

The experienced agent in the Diplomatic Security Service (DSS) was cuffed last Monday after becoming irate when staff at the iconic Hotel Amigo refused to reopen the bar after hours, the Washington Examiner reported.

The bodyguard then became physically aggressive when staff, including the hotel night manager, tried to persuade him to return to his room, sources told the outlet.

The White House’s push for for expanded presidential power threatens US economic stability

Donald Trump is systematically purging every US government institution, a pattern familiar to anybody who has studied the caudillo regimes of Latin America, or the playbook of today’s Putin-Orbán-Erdoğan prototypes.

It is a racing certainty that he will soon do the same to the Federal Reserve, forcing the central bank to cut interest rates into the teeth of rising inflation, with epic consequences for the world’s dollarised financial system and for €39 trillion (£33 trillion) of offshore dollar debt contracts and swaps.

Late last week he fired the head of the National Security Agency and its top officials at the behest of Laura Loomer, a fringe conspiracy theorist, who whispered into Trump’s ear that they were disloyal to the Maga movement.

He has already fired the heads of the FBI’s intelligence division, its counterterrorism division and criminal investigations division, as well as the heads of the Washington and New York offices.

He has fired the top brass of the US military, starting with a preemptive strike on the chairman of the joint chiefs of staff. An earlier chairman – General Mark Milley – refused to ratify Trump’s attempted coup d’etat on Jan 6 2021.

“We don’t take an oath to a king, or to a tyrant or dictator, and we don’t take an oath to a wannabe dictator. We take an oath to the constitution,” said Milley in his parting shot.

But Trump also fired the three judge advocates general, who are legally independent by Congressional statute and have the authority to decide which military orders should be disobeyed – such as Trump’s order to “just shoot” American protesters, on American soil, during the Black Lives Matter saga.

That obstacle will not recur. Pete Hegseth, the defence secretary, said the three judges had been sacked to stop them posing any “roadblocks to orders given by the commander-in-chief”.

You can go through the list, agency by agency, extending to the universities and private law firms, and even to the muzzled editorials of some of America’s once great newspapers: the purge is Bolshevik in ambition.

Does anybody in their right mind think that Trump will spare the Fed’s Jerome Powell as the two men gear up for an almighty clash over US monetary policy? “CUT INTEREST RATES, JEROME, AND STOP PLAYING POLITICS!” bellowed Trump in capital letters on Truth Social on Friday.
