Latin Times: Undocumented Florida Woman Fined $1.82 Million by ICE for 20-Year Overstay

An undocumented Honduran woman living in Florida has been fined over $1.82 million by U.S. Immigration and Customs Enforcement (ICE) for failing to depart the country following a 2005 removal order.

The fine, issued in a May 9 notice by ICE’s civil fines department, charged the woman $500 for each day she remained in the United States since the order was issued, totaling $1,821,350. The woman, a mother of three U.S.-born children, is being represented by immigration attorney Michelle Sanchez, who said this is the first time she has seen such a high civil penalty imposed.

“This is ICE terrorizing individuals without even having to go pick them up,” Sanchez told CBS News. “They are terrorizing them by sending these notices where they are fining individuals an exorbitant amount of money that a person sometimes doesn’t even make that amount in their lifetime.”

Daily Express: Supreme Court justice mocks Trump’s move to end birthright citizenship

The Trump administration has asked the Supreme Court to consider ending the judicial power for sweeping injunctions, but did not ask for a ruling on the constitutionality of birthright citizenship.

President Donald Trump has been ridiculed by Supreme Court Justice Elena Kagan after he proposed to put an end to birthright citizenship.

Appointed by former President Barack Obama, Kagan chastised the U.S. Solicitor General John Sauer for not challenging Trump’s orders and for challenging the judicial authority to issue nationwide injunctions, a move that makes no sense for the administration’s ultimate goal.

“Nobody is going to lose this case,” Kagan said, stating that any parent whose kids are denied American citizenship can uphold the 14th Amendment, which guarantees the right of citizenship to anyone born on American soil.

“It’s just, you’re going to have, like, individual by individual by individual, and all of those individuals are going to win,” Kagan said.

She added that the only people who could lose are the ones who cannot afford to challenge the administration.

Before Sauer could answer, Kagan cut him off again.

Sauer began, “The tools that are provided to address hypotheticals like this…”

And a coup de grâce from Justice Kagan:

“This is not a hypothetical. This is happening out there, right? Every court has ruled against you,” Kagan said.

Scripps News: Grand jury indicts Milwaukee judge arrested in immigration case, allowing charges against her to proceed

A federal grand jury indicted Milwaukee Judge Hannah Dugan on charges including concealing an individual to prevent arrest and obstruction, allowing a case that began against her in April to continue.

The indictment is related to the charges federal prosecutors brought in a complaint against Dugan after she allegedly helped a man evade immigration officials in the courtroom. The indictment verifies the initial complaint and allows federal prosecutors to pursue the charges.

According to the complaint against Dugan, she directed Flores-Ruiz and his attorney to leave through a door that is reserved for jury members, court staff, deputies and defendants who are in custody.

Chicago Sun-Times: Immigration agents arrested a U.S. citizen and created warrants after an arrest, lawyers say in court

Chicago attorneys with the National Immigrant Justice Center and the ACLU of Illinois accused the federal government of violating immigration law and the constitutional rights of at least 22 people who were arrested and detained in the Midwest since President Donald Trump’s inauguration as part of his crackdown on immigration.

Two people are still in custody, 19 were released on bond and one has already been deported.

Attorneys say these actions violate the Nava Settlement — a 2018 class-action lawsuit filed in response to unlawful arrests by ICE agents who used traffic stops and other tactics to make arrests without a warrant. Under the agreement, ICE officials can conduct a warrantless arrest if they believe an individual is likely to escape, but they must provide evidence. In the motion filed Thursday in federal court in Chicago, attorneys said federal agents since January had “failed to assess whether there was probable cause that an individual was likely to flee before a warrant could be issued.”
