Newsweek: Trump supporter detained by ICE Agents regrets vote: “Were all brainwashed”

A California man who voted for President Donald Trump has spoken out after being detained by immigration agents.

Brian Gavidia, a 29-year-old American citizen from Montebello, joined a lawsuit challenging immigration enforcement tactics after federal agents detained him on June 12, NBC 4 Los Angeles reported.

“I truly believe I was targeted because of my race,” Gavidia told the outlet, adding elsewhere in the interview, “We were all brainwashed.”

“While conducting a lawful immigration enforcement operation in Montebello, CA, Brian Gavidia was arrested for assaulting a law enforcement officer and interfering with agents during their duties,” Department of Homeland Security Assistant Secretary Tricia McLaughlin told Newsweek.

“Javier Ramirez was detained on the street for investigation for interference and released after being confirmed to be a U.S. citizen with no outstanding warrants,” she added.

Gavidia voted for Trump, believing that his administration’s immigration agenda would target criminals, not everyday citizens, NBC 4 Los Angeles reported.

He told the outlet that during an immigration enforcement operation in the San Gabriel Valley, a federal agent pushed him against a wall and demanded proof of citizenship, asking him the name of the hospital where he was born.

Footage circulating on social media shows Gavidia shouting, “I was born here in the states, East LA bro!”

The video shows agents, who are wearing vests with “Border Patrol Federal Agent” on them, holding Gavidia’s hands behind his back.

Agents allegedly confiscated his Real ID and phone. Gavidia was later released and recovered his phone, but he said he never received his ID.

Convinced he was targeted because of his Latino heritage, Gavidia now rejects his prior support for the president.

“I believe it was a mistake because he ran on lies,” Gavidia said. “He said criminals.”

“If this was going to happen, do you think we would have voted? We’re humans. We’re not going to destroy our community. We’re not going to destroy our people,” he continued.

“We were all manipulated. We were all brainwashed,” Gavidia told NBC 4 Los Angeles. “And now look at us. We are all suffering because of it, and I feel guilty 100 percent.”

Gavidia is among seven plaintiffs in an American Civil Liberties Union lawsuit that resulted in a court order limiting when federal agents can initiate immigration enforcement.

The filing requested that the court prohibit raids conducted without reasonable suspicion or probable cause. It also said agents concentrated operations in places where Latino workers were often found, such as local car washes and outside Home Depot locations.

California has been a key battleground state for immigration enforcement operations after Trump ordered federal agents to ramp up arrests in Democratic cities.

On August 1, the Ninth Circuit Court of Appeals upheld a temporary restraining order, originally issued by a federal judge, that placed limits on how the federal government could carry out immigration enforcement operations in Southern California.

An attorney for the Trump administration argued before a three-judge panel of the Ninth Circuit Court of Appeals in San Francisco, seeking a stay of the temporary restraining order while the case was appealed. The panel denied the request.

The decision upholds a July 11 ruling granting a restraining order sought by immigrant rights advocates to limit federal immigration enforcement in Los Angeles and other areas of Southern California. Under Judge Maame E. Frimpong’s directive, officers and agents may not detain individuals unless they have reasonable suspicion that the person is in the United States in violation of immigration law.

Brian Gavidia told NBC 4 Los Angeles: “I believe I was racially profiled. I believe I was attacked because I was walking while brown. Where is the freedom? Where is the justice? We live in America. This is why I’m fighting today. This is why I’m protecting the Constitution.”

What Happens Next

Despite the legal restrictions, immigration raids continue. The Trump administration has appealed the Ninth Circuit’s decision that upheld the temporary restraining order. The case is now before the U.S. Supreme Court, which will decide whether to lift or uphold the restrictions limiting broad-based immigration enforcement in Los Angeles.

Guardian: Ice raids in LA continue as armed agents target immigrant communities

US immigration raids continued to target southern California communities in recent days, including at a popular flea market and in a Los Angeles suburb where US citizens were detained.

On Saturday, as mass protests swept the nation, including tens of thousands demonstrating in LA, Immigration and Customs Enforcement (Ice) agents descended on a swap meet in Santa Fe Springs in southeast LA county. Video showed dozens of heavily armed, masked officers carrying out the raid before a scheduled concert at the long-running event that features vendors, food and entertainment every weekend.

Witnesses told the Los Angeles Times that agents appeared to be going after people who “looked Hispanic in any way”, sparking widespread fear.

New York Times: ‘I’m an American, Bro!’: Latinos Report Raids in Which U.S. Citizenship Is Questioned

A raid in Montebello, Calif., has stirred fears that federal agents are detaining and racially profiling U.S. citizens of Hispanic descent.

They swept into the Southern California car lot last Thursday at 4:32 p.m. — masked and armed Border Patrol agents in an unmarked white S.U.V.

One agent soon twisted Jason Brian Gavidia’s arm and pressed him against a black metal fence outside the lot where he runs an auto body shop in Montebello, a working-class suburb east of the Los Angeles city limits. Another officer then asked him an unusual question to prove whether he was a U.S. citizen or an undocumented immigrant.

“What hospital were you born at?” the Border Patrol agent asked.

Mr. Gavidia, 29, was born only a short drive from where they were standing, in East Los Angeles. He did not know the hospital’s name. “I was born here,” he shouted at the agent, adding, “I’m an American, bro!”

Mr. Gavidia was eventually released as he stood on the sidewalk. But another U.S. citizen, Javier Ramirez, 32 — Mr. Gavidia’s friend and co-worker — had been forced facedown to the ground by two agents in the car lot. Mr. Ramirez was put inside a van and driven to a federal detention center, where he remains in custody. Mr. Ramirez’s lawyer said that officials at the detention center had denied his request to speak to his client.

“I know enough to know this is not right at all,” Mr. Gavidia said in an interview. “Latinos in general are getting attacked. We’re all getting attacked.”

The episode on Thursday was captured on video by Mr. Gavidia’s friend and the car lot’s security cameras, and described in interviews with Mr. Gavidia, Mr. Ramirez’s lawyer and another man who was at the shop during the raid.

This is America? Sooner or later one of their victims will kill some of these thugs in self defense.

The spokesperson said one person had attempted to flee the scene, had assaulted an agent in the process and was arrested for having assaulted and interfered with agents. Another person was detained on the street for investigation for interference but was released after being confirmed to be a U.S. citizen. And a third person, the official said, was determined to be “an illegal alien” and was taken into custody without incident.

Tricia McLaughlin, a spokeswoman for the Homeland Security Department, which oversees the Border Patrol as well as Customs and Border Protection, said in a statement that Kristi [Bimbo #2] Noem, the homeland security secretary, “has been clear: If you lay a hand on a law enforcement officer, you will be prosecuted to the fullest extent of the law.”

Payback is coming. It’s only a matter of time before the victims start responding with force of their own. The ICE thugs will get no sympathy from me.

As agents questioned Mr. Gavidia on the sidewalk, they pressed him against the fence and he repeatedly and loudly told them he could show identification to prove his citizenship. They dropped his arms and he reached for his California driver’s license.

The agents then confiscated both his license and his cellphone, Mr. Gavidia said. He pleaded with them for several minutes and the officer eventually returned his phone but never gave his license back, Mr. Gavidia said.

KTLA: Southern California father who is U.S. citizen, arrested during immigration raid, family says

Family members are demanding answers after they say a man who is a U.S. citizen was wrongfully arrested by federal agents during an immigration raid in Montebello. 

On June 12, surveillance video captured the moment several masked and armed agents surrounded a tow truck business in Montebello.

The agents quickly entered the property and began detaining mechanics and other workers at the site.

One of the detained men who was later released spoke to KTLA but asked not to be identified out of safety concerns. He said he was violently grabbed and taken by the agents despite being a U.S. citizen.

“He slammed me to the gate,” the man told KTLA’s Ellina Abovian. “He put my hands behind my back. I’m an American citizen. You do not do that to Americans.”

Nataly Degante, whose cousin, Javier Ramirez, 32, was arrested in the raid, said that while agents began handcuffing everyone, they reportedly never provided identification or information about why they were there.

“We see in the video that they don’t come with a warrant,” she said. “They don’t have any documentation in their hands.”

Degante said her cousin is a U.S. citizen and a single father of two young children. She described him as a hard worker with no criminal record.

Video of the raid shows some workers being moved to the ground as agents quickly handcuffed them. Ramirez is also seen on the video yelling to the agents that he’s a citizen.

“He’s telling them he is a U.S. citizen and he’s letting them know, ‘My passport is in my pocket,’” Degante said.  

However, Ramirez was handcuffed and taken into custody. His brother tried following Ramirez’s location through his cell phone’s tracking app, but the signal was eventually lost. His family has not heard from him since.

“We haven’t heard anything about him,” said Abimael Dominguez, his brother. “He’s diabetic. I don’t even know if he has insulin yet or has he eaten? We don’t know anything. “

It remains unclear whether the agents were with U.S. Immigration and Customs Enforcement (ICE) or the Department of Homeland Security (DHS). Some of the agents appeared to be wearing uniforms with a Border Patrol insignia. 

“I voted, but not for this,” said the man who was detained and later released. “I’m an American citizen. I want the best for all of us. I feel like there is due process that we must follow.”

“They’re not only taking criminals, they are taking our community,” Degante said.

As of Friday afternoon, Homeland Security has not responded to KTLA’s request for comment about why Ramirez was detained or whether he was wanted for any crimes.
