House Democratic Leadership has strongly condemned interim U.S. attorney for the District of New Jersey Alina Habba’s decision to charge Rep. LaMonica Mclver (D-N.J.), calling it “an attack on the American people.”
The Justice Department announced on Monday that it has filed charges against McIver, accusing her of assaulting law enforcement officers earlier this month at an Immigration and Customs Enforcement (ICE) facility in Newark.
In a statement released Monday, House Democrats said the party “will respond vigorously in the days to come at a time, place and manner of our choosing.”
“The criminal charge against Congresswoman LaMonica McIver is extreme, morally bankrupt and lacks any basis in law or fact,” said the statement, shared by House Minority Leader Rep. Hakeem Jeffries (D-N.Y.) on the social platform X.
“Members of Congress have a constitutional responsibility to conduct oversight of the executive branch wherever and whenever it is needed. We are lawfully permitted to show up at any federal facility unannounced to conduct an inspection on behalf of the American people,” the Democratic lawmakers said.
“By visiting the detention center in Newark, Rep. McIver and two other Members of Congress were upholding their oath of office. They didn’t assault anyone, but were themselves aggressively mistreated by illegally masked individuals,” the statement added.
“There is no credible evidence that Rep. McIver engaged in any criminal activity, and she would not have been permitted to tour the facility had she done anything wrong,” the Democratic leadership said.
The statement further said that the proceeding launched “by the so-called U.S. Attorney in New Jersey is a blatant attempt by the Trump administration to intimidate Congress and interfere with our ability to serve as a check and balance on an out-of-control executive branch.”

As far as we’ve heard, a lot of Democrats make the argument that they’re just conducting oversight, congressional oversight.”

Knewz: Two Dems Confront ICE Agents: ‘Simply Do Our Job’
Knewz.com is reporting that two Democratic representatives from New Jersey have protested at the Delaney Hall Detention Center in Newark, demanding its closure due to concerns over criminality. Rep. Robert Menendez, Jr. (D-NJ) and Rep. LaMonica McIver (D-NJ) confronted ICE agents during the protest, with McIver attempting to breach security checkpoints to enter the facility. Delaney Hall houses detainees with alleged gang affiliations.
Regarding claims that McIver body-slammed an officer, she stated, “I mean, I honestly do not know how to body slam anyone. There’s no video that supports me body slamming anyone. We, as Congresswoman Bonnie Watson Coleman said we were simply there to do our job. There for an oversight visit.”
McIver added, “What you watch what you’re watching in the video, and we don’t have all of the body cam, and we hope that all of the body cam is released. It was a very tense situation. It unfortunately did not have to be like that. They created that confrontation. They created that chaos and then ultimately went to arrest the mayor of the largest city of New Jersey, who is my mayor and my constituent. And it was very difficult to watch that happen. But absolutely, I did not body slam anyone.”
U.S. Attorney for the District of New Jersey Alina Habba [Bimbo #4] reported that Newark Mayor Ras Baraka (D-NJ) ignored multiple warnings to leave the premises and was arrested for trespassing during the protest. Baraka was released later in the evening amid demonstrations from supporters.

USA Today: Trump uses Supreme Court birthright citizenship case in bid to limit judges’ power
President Trump is counting on the Supreme Court to limit the ability of judges to put his policies on hold while they’re being challenged.
Judges across the country have blocked some of President Donald Trump’s biggest policy changes − roadblocks the president has called “toxic and unprecedented.”
Trump is counting on the Supreme Court to fix that.
How inclined the justices might be to do so could become apparent on May 15 when the court considers Trump’s move to end automatic citizenship for children born in the United States regardless of whether their parents are citizens or permanent residents.
The president hasn’t yet asked the high court to consider the legality of his policy – which was called “blatantly unconstitutional” by the first judge to review it.
Instead, Trump wants the justices to narrow the scope of multiple court orders keeping his new rules on hold until the citizenship policy has been fully litigated.
The administration argues that, for now, Trump should be able to impose the change on everyone except the 18 parents named in the lawsuits or, at most, any member of two immigrant rights groups or residents of a state that challenged the policy.

A coalition of attorneys general across 15 states is suing the Trump administration over declaring a “national emergency” on the first day of Donald Trump‘s presidency.
On January 20, President Trump declared a “national energy emergency” via executive order, over what he claimed to be “our Nation’s inadequate energy supply.”
The attorneys general from Washington and California say this is not true, and that US energy production is actually at “an all time high.”
“Washington state filed suit today alongside 14 other states to challenge the president’s fake “energy emergency,” declared to line the pockets of Big Oil by handing out free passes to pollute our environment,” said Washington Attorney General Nick Brown on May 9.

According to Business Insider, Musk is telling workers in Texas to take a week off:
Tesla told Austin workers on its Model Y and Cybertruck lines to stay home for the week of Memorial Day, three workers told Business Insider.
The break is unusually long, the workers said. Production lines were up and running during the same period last year, they said.
The electric vehicle maker notified employees earlier this week. The workers, who are paid hourly, were told they could either take paid time off or come in for cleaning and training but would not be working on the production line.
The workers said their schedules had been increasingly inconsistent since February. Some said they had been sent home early on multiple occasions.

Guardian: Trump officials ‘created confrontation’ that led to arrest of Newark mayor
Democratic Congress members who visited detention center with mayor say Ice officials ‘created the chaos’
Trump administration homeland security officials were responsible for starting the confrontation on Friday at a New Jersey immigration jail that led to the arrest of Newark’s mayor as well as threats to detain three members of Congress, the representatives said Sunday on CNN’s State of the Union.
The Democratic representatives Bonnie Watson Coleman, LaMonica McIver and Rob Menendez – all of New Jersey – visited the controversial Immigration and Customs Enforcement (Ice) detention center known as Delaney Hall on Friday to inspect the facility. As they waited to enter Delaney Hall, Newark’s mayor, Ras Baraka, arrived – and as he left the property, he was arrested outside by Ice officials accusing him of trespassing, leading to a commotion at the entrance of the jail.
There evidently was shoving and pushing between federal immigration officials and the members of Congress, which Watson Coleman, McIver and Menendez blamed on the immigration officials.
On CNN’s State of the Union, the Congress members said immigration officials had ample opportunity to deescalate the situation before someone called in and instructed masked agents to arrest Baraka.
“They created that confrontation, they created that chaos,” McIver said.
Since the ordeal on Friday at Delaney Hall, homeland security officials have accused the Congress members of staging a “bizarre political stunt” there while also accusing McIver of “bodyslamming” authorities at the scene.
McIver rejected those allegations.
“I honestly do not know how to bodyslam anyone,” McIver said. “There’s no video that supports me bodyslamming anyone.
“We were simply there to do our job – there for an oversight visit.”

Newark Democratic Mayor Ras Baraka was arrested on Friday for allegedly trespassing at an Immigration and Customs Enforcement detention facility in the city.
Shortly afterward, Acting U.S. Attorney for the District of New Jersey Alina Habba phoned into Fox News to gloat about it.
Baraka and three New Jersey Democratic members of Congress – Rep. Monica McIver, Rep. Bob Menendez Jr., and Bonnie Watson Coleman – visited the facility, Delaney Hall, which is anticipated will hold 1,000 immigrants. Habba tweeted about Baraka’s arrest and claimed the mayor was trespassing.
“The Mayor of Newark, Ras Baraka, committed trespass and ignored multiple warnings from Homeland Security Investigations to remove himself from the ICE detention center in Newark, New Jersey this afternoon,” she wrote. “He has willingly chosen to disregard the law. That will not stand in this state. He has been taken into custody. NO ONE IS ABOVE THE LAW.”
