Washington Post: D.C. judges and grand jurors push back on Trump policing surge

A federal grand jury refused to indict a man who threw a sandwich at a federal officer, and grand jurors refused three times to indict a woman accused of assaulting an FBI agent.

President Donald Trump’s surge of federal law enforcement on the streets of D.C. is meeting resistance in the city’s federal courthouse, where magistrate judges have admonished prosecutors for violating defendants’ rights and court rules, and grand jurors have repeatedly refused to issue indictments.

On Tuesday, a federal grand jury refused to indict a former Justice Department employee who threw a sandwich at a federal law enforcement agent in an incident this month that went viral on social media, according to two people with knowledge of the case who spoke on the condition of anonymity because they weren’t authorized to discuss it publicly. Prosecutors had sought to charge Sean Charles Dunn with a felony count of assaulting, resisting or impeding a federal officer.

Trump declared a crime emergency this month, giving federal law enforcement agencies and National Guard members unprecedented authority to patrol the nation’s capital, while also enlisting the District’s 3,100-member police force to assist with immigration enforcement. More than 1,000 arrests have followed, according to the White House. Meanwhile, D.C.’s top prosecutor, Jeanine Pirro, ordered her staff to file the stiffest possible charges in every case.

But there are emerging signs that not all of the arrests will stand up to scrutiny in court.

Before prosecutors failed to indict Dunn, a grand jury on three separate occasions this month refused to indict a D.C. woman who was accused of assaulting an FBI agent, another extraordinary rejection of the prosecution’s case. Days later, a federal magistrate judge said an arrest in Northeast Washington was preceded by the “most illegal search I’ve seen in my life” and described another arrest as lacking “basic human dignity.”

While judges are known to criticize prosecutors from time to time, grand jurors only in rare cases refuse to issue an indictment, which requires them to find only probable cause that a crime was committed, the lowest evidentiary bar in criminal cases. Instances of failed indictments have begun to crop up more since Trump took office this year. Grand jurors in Los Angeles have rejected indictments of people who were arrested for protesting the administration’s immigration enforcement actions, according to the Los Angeles Times.

The July 22 scuffle at issue in D.C. federal court occurred weeks before Trump’s law enforcement order, but the grand jurors were presented with the case this month just as federal agents were descending on Washington.

Prosecutors alleged that Sydney Reid was obstructing and recording agents from the FBI and U.S. Immigration and Customs Enforcement as they attempted to arrest a gang member being released from the D.C. jail who was slated for deportation. An FBI agent scraped her hand against a wall amid the fracas, and prosecutors planned to charge Reid with assaulting, resisting or impeding a federal officer, a felony offense punishable by up to eight years in prison.

Under the Fifth Amendment, however, charges that carry potential penalties of more than a year in prison must be approved by a grand jury. At least 12 members must vote to authorize an indictment. After striking out with the D.C. grand jury, prosecutors dropped the effort to charge Reid with a felony and instead filed a misdemeanor charge that does not require grand jury approval. The maximum penalty for the misdemeanor is one year in jail.

“After Ms. Reid was wrongfully arrested, the ICE agent told her, ‘You should have just stayed home and minded your business,’” Reid’s public defenders, Tezira Abe and Eugene Ohm, said in a statement. “As a United States citizen and a compassionate person, caring about fellow D.C. residents getting snatched off the streets by ICE agents is her business and should be of concern to all human beings.”

They added: “The U.S. attorney can try to concoct crimes to quiet the people but in our criminal justice system, the citizens have the last word. We are anxious to present the misdemeanor case to a jury and to quickly clear Ms. Reid’s name.”

Several recent cases, including Dunn’s, have involved the same felony statute that prosecutors tried to apply to Reid’s case.

Pirro declined to speculate about how juries in D.C., where 90 percent of voters cast ballots for Trump’s opponent in the 2024 presidential race, might respond to criminal cases as the federal crackdown continues.

“The only thing that I can say is we are prosecutors. We are the tip of the spear. We are the ones who take these cases into court, and the burden is on us to prove these cases, and we welcome that burden — beyond a reasonable doubt,” Pirro said at a news conference Tuesday. “Sometimes a jury will buy it and sometimes they won’t. So be it. That’s the way the process works.”

A spokesman for Pirro did not say whether federal prosecutors would try to present the Dunn case to a grand jury a second time. The spokesman, Timothy Lauer, alleged that a government lawyer had violated a court rule requiring confidentiality in grand jury proceedings by disclosing the decision not to indict Dunn. The grand jury’s move in that case was first reported by the New York Times. Dunn’s attorney, Sabrina Shroff, declined to comment.

U.S. Magistrate Judge G. Michael Harvey said at a hearing this month that prosecutors should have promptly notified the court about the grand jury’s decision not to indict Reid but that they held off for days, violating a court rule. “I’ve taken up that issue with the U.S. attorney’s office,” Harvey said last week.

But the most pointed criticisms of Trump’s law enforcement surge have come from Magistrate Judge Zia M. Faruqui, who has castigated law enforcement officials for wearing masks while tackling and arresting a Venezuelan national who worked as a food-delivery driver, for disobeying an order the judge issued this week to release a woman from the D.C. jail, and for arresting and jailing a 37-year-old because “he was a Black man going into Trader Joe’s.”

“I’d say we live in a surreal world right now,” Faruqui said at a court hearing for Christian Enrique Carías Torres, who was taken down by masked federal agents as he exited a Bluestone Lane coffee shop with a delivery order, an arrest that was captured on video by a Washington Post reporter.

“This is not consistent with what I understand the United States of America to be,” the judge told Carías Torres. “You should be treated with basic human dignity. We don’t have a secret police.”

Pirro’s office said in a court filing that Carías Torres ran after officers approached him, struggled as he was being taken down and tried to flee from a police vehicle after being handcuffed, adding that he had missed his immigration court hearings since entering the country in 2023.

Violent crime is down 27 percent so far this year compared with the same period in 2024, according to D.C. police data, and has declined 51 percent when measuring the year-over-year period since Trump issued his order Aug. 11.

The president has painted a portrait of “crime, bloodshed, bedlam and squalor” in the District, blaming years of passive policing by local authorities and lenient criminal justice policies from Democratic officials.

“But now they are allowed to do whatever the hell they want,” Trump said of D.C. police as he announced his moves. He said criminals in the city are rough and tough, “but we’re rougher and tougher.”

Carías Torres was charged with assaulting, resisting or impeding federal officers, just as Dunn and Reid had been, after an officer injured his head while helping take him to the ground. Faruqui ordered that Carías Torres be released pending trial, acknowledging that ICE would have an opportunity to take him into custody to enforce a removal order issued by an immigration court last year.

In another case, federal prosecutors charged Kristal Rios Esquivel with a felony violation of the same statute, which makes it illegal to assault federal officers. Her alleged offense started when she walked through a door that was marked “staff only” at the National Zoo’s bird house, tripping an alarm. As National Zoo Park Police officers arrested her for unlawful entry, Rios Esquivel spat on two of them and kicked one, prosecutors alleged. Her attorney has criticized the arrest as an instance of overpolicing.

Rios Esquivel was held for five days in the D.C. jail before making her initial appearance Monday in Faruqui’s courtroom, which Faruqui said was bad enough. The judge ordered Rios Esquivel released pending trial, but the D.C. Department of Corrections did not free her the same day. Faruqui threatened to impose sanctions in a scathing order issued Tuesday that said officials had subjected Rios Esquivel to illegal detention, and she was released.

“What is especially troubling is that this is not even the first time in the past four months that the Court has encountered this same problem of false imprisonment,” Faruqui wrote, citing another case from April.

At yet another court hearing scrutinizing police tactics in D.C., Faruqui reprimanded federal prosecutors this week for charging Torez Riley with illegally possessing firearms. The judge found that D.C. police officers, who were on patrol with federal agents, violated Riley’s privacy rights by searching his bag, where they found two guns. Riley had previously been convicted of weapons offenses, prosecutors said.

Police said in court documents that Riley’s bag had been searched in part because it appeared to contain something heavy. But that observation was not enough to show probable cause that Riley had committed a crime, the court found.

It was “without a doubt, the most illegal search I’ve seen in my life,” said Faruqui, a former D.C. federal prosecutor, adding that Riley had been jailed and kept away from his three children and pregnant wife for a week because “he was a Black man going into Trader Joe’s.”

Pirro’s office then filed court papers to dismiss the case, and the judge ordered Riley released from a D.C. jail facility.

A spokesman for Pirro said that as soon as she “was shown the body-worn camera footage on Friday, she ordered the dismissal of the charges.” The motion to dismiss was filed Monday.

In response to Faruqui’s criticisms, Pirro said in a statement: “This judge has a long history of bending over backwards to release dangerous felons in possession of firearms and on frequent occasions he has downplayed the seriousness of felons who possess illegal firearms and the danger they pose to our community.”

But Faruqui also admonished Riley over his firearm possession. “You will die, you will kill somebody, or you will end up in jail,” the judge said.

Riley is set to face consequences in Maryland, where Faruqui said authorities would use what they learned in the “blatantly illegal” D.C. search to show he violated his probation in an earlier gun possession case. A bench warrant was issued Monday over the probation violation, according to records from Prince George’s County Circuit Court.

Riley’s wife, Crashawna Williams, said she took a week off from the beauty classes she’s enrolled in to deal with her husband’s case while taking care of their boys, ages 3, 8 and 12.

“I feel like he shouldn’t have been arrested in the first place,” Williams said. But, she added, what could they do?

NBC News: Stanford student newspaper sues Trump officials over immigration law that they say led to chilling of free speech

The Stanford Daily accused the administration of using immigration provisions to threaten deportation, leading to censorship and violating First Amendment rights.

Stanford University’s student newspaper sued the Trump administration Wednesday over two provisions in federal immigration law that it says the officials have wielded against those with pro-Palestinian views.

The Stanford Daily, in addition to two former college students, filed the lawsuit against Secretary of State Marco Rubio and Homeland Security Secretary Kristi Noem, accusing the administration of using the provisions to threaten deportation and the revocation of visas. They say the situation has led to censorship and violations of free speech rights.

The paper’s staff members who are on visas have self-censored and declined assignments related to the war in Gaza, fearful that their reporting could jeopardize their lawful immigration status, the lawsuit said.

“In the United States of America, no one should fear a midnight knock on the door for voicing the wrong opinion,” Conor Fitzpatrick, an attorney at the Foundation for Individual Rights and Expression, which is helping represent the plaintiffs, said in a statement. “Free speech isn’t a privilege the government hands out. Under our Constitution it is the inalienable right of every man, woman, and child.”

A senior State Department official declined to comment and directed NBC News to comments Rubio has about visa holders and complying with U.S. law.

In April, Rubio wrote in an opinion piece published on Fox News that he would be taking a “zero-tolerance approach to foreign nationals who abet terrorist organizations.”

“The Supreme Court has made clear for decades that visa holders or other aliens cannot use the First Amendment to shield otherwise impermissible actions taken to support designated foreign terrorist organizations like Hamas, Hizballah, or the Houthis, or violate other U.S. laws,” Rubio said.

Tricia McLaughlin, spokesperson for the Department of Homeland Security, described the lawsuit as “baseless.”

“There is no room in the United States for the rest of the world’s terrorist sympathizers, and we are under no obligation to admit them or let them stay here,” she said in a statement.

In the lawsuit, the plaintiffs take aim at the Deportation Provision and Revocation Provision in the Immigration and Nationality Act. The first provision allows the secretary of state to deport noncitizens if the secretary “personally determines that the alien’s admission would compromise a compelling United States foreign policy interest.” The second gives the secretary the power to revoke a visa or documentation at his or her discretion.

As the lawsuit points out, the Trump administration has cited the Deportation Provision as the basis for trying to deport Columbia University activist Mahmoud Khalil, who was arrested and detained for more than three months. Similarly, the administration used the Revocation Provision to detain Tufts University student Rümeysa Öztürk, who has also since been released.

Because of the administration’s use of the statutes, the lawsuit said, the Stanford Daily has received a number of requests from lawfully present noncitizens to have their names, quotes or photos removed from articles. Many international students have stopped speaking to the paper’s journalists, and current and former writers have asked for their opinion editorials to be taken down, the lawsuit said.

“The First Amendment cements America’s promise that the government may not subject a speaker to disfavored treatment because those in power do not like his or her message,” the lawsuit said. “And when a federal statute collides with First Amendment rights, the Constitution prevails.”

One of the unnamed plaintiffs appeared on the Canary Mission, the suit said. The website, run by an anonymous group, has published a detailed database of students, professors and others who it says have shared anti-Israel and antisemitic viewpoints. It has been accused of doxxing and harassment, in addition to launching personal attacks that depict pro-Palestinian activists as being in “support of terrorism,” the Middle East Studies Association of North America said. The plaintiff has stopped publishing and “voicing her true opinions” on the Palestinian territories and Israel, the suit said.

Canary Mission has told NBC News that it documents people and groups who “promote hatred of the USA, Israel and Jews” across the political spectrum. It did not respond to criticisms of its work.

The plaintiffs are asking the court to issue preliminary and permanent injunctions that block the officials from using the provisions against them based on engaging in what they consider protected speech.

“There’s real fear on campus and it reaches into the newsroom,” Greta Reich, the Stanford Daily’s editor-in-chief, said in a statement. “The Daily is losing the voices of a significant portion of our student population.”

Bare minimum, he associated with pedophiles.

Why is this so hard to understand?

Why isn’t this the end of the road for this monster?

Why isn’t this the only thread that is being pulled on right now with urgency by our bought-off and/or incompetent mainstream media?

Why isn’t every American calling (202) 224-3121 (that’s the U.S. Capitol switchboard) and demanding that Trump release the Epstein files like he said he would on the campaign trail?

Thank God, identifying and stomping out pedophiles is not yet a partisan issue in America.

An unheard of 82 percent of Americans — including 76 percent of Republicans — want these files released immediately. And while Democrats are doing what they procedurally can to get at the files, it will take time that we should all have decided by now that we do not have.

Shouldn’t Americans know, and just as soon as possible, the full details of their president’s relationship with a man who raped children? And shouldn’t THAT finally end the long, national nightmare we have endured for 10 years, while this dirty old man breaks everything in his blurry sight?

We know without a shadow of a doubt he stalked girls in the dressing rooms of Miss Teen USA beauty competitions, because “(He’s) seen it all before, and (he’s) the owner of the pageant. And therefore (he’s) inspecting it.”

He’s posting INSANE distractions on his SOCIAL media channels THAT are ODDly capitalized and carrY the grammatical WAIT of a 4-year-OLD who has Trapped himself in a DOOR jam.

They have quietly moved the disgusting Ghislaine Maxwell, Epstein’s ex-girlfriend and co-conspirator, to a cushy federal prison in Texas. WHY?

Trump has no answers, which is why we need to keep asking this question:

Meantime, the stink has somehow gotten even worse, because there is breaking news that it has taken only six months for Trump to destroy the solid economy Joe Biden helped meticulously build after inheriting Trump’s mess in 2021 following the attempted insurrection.

Trump inherited the strongest economy in the entire world, and has screwed it up in record time. Job growth has stalled again, and is at a 16-year low — or the last time a Democrat was fixing a battered economy left in shambles by a Republican.

Prices are rising, not falling.

Why did anybody think it would be any different this time around?

Here’a another fact that never gets enough attention: Democrats make economies and Republicans break them. Go ahead, look that up.

I could stand to hear a helluva lot more about this, too, because while billionaires are being rewarded like never before in America, the rest of us are getting royally screwed.

The numbers back this up.

Right now, though, I want to know why our president is providing safe haven for pedophiles.

President Donald Trump lashed out at both Russia and India in a Truth social post at midnight on Thursday, as he doubled down on the 25% tariffs he placed on New Delhi—along with an unspecified “penalty” for its continued trade with Moscow—and attacked former Russian president and key Putin ally, Dmitry Medvedev, who warned that Trump’s ultimatums against his country were a “step towards war.”

While announcing his plan to impose a 25% tariff on India, Trump pointed out that the country has “always bought a vast majority of their military equipment from Russia” and is the “largest buyer” of Russian energy after China.

This was the first instance of the president following through with his threat to impose “secondary tariffs” on Russia’s key trading partners unless Moscow agrees to end its war in Ukraine.

Trump, however, didn’t specify what this penalty would entail.

What Do We Know About Trump’s Deadline For Russia?

Earlier this month, Trump threatened to impose 100% “secondary” tariffs on Russia, unless it managed to secure a deal to end the war in Ukraine in 50 days. These secondary tariffs would target countries like India and China, which are among Russia’s key trading partners. However, the president revised his deadline on Monday during his visit to Scotland and said Moscow now has 10 to 12 days to take steps towards ending its conflict with Ukraine.

What Has Medvedev Said About Trump’s Deadline For Russia?

When Trump announced the first deadline, Medvedev mocked it in a post on X, saying: “Trump issued a theatrical ultimatum to the Kremlin. The world shuddered, expecting the consequences. Belligerent Europe was disappointed. Russia didn’t care.” After Trump shortened the deadline on Monday, Medvedev responded, tweeting: “Trump’s playing the ultimatum game with Russia…He should remember 2 things: 1. Russia isn’t Israel or even Iran. 2. Each new ultimatum is a threat and a step towards war. Not between Russia and Ukraine, but with his own country. Don’t go down the Sleepy Joe road!”

What Did Trump Say About Medvedev?

The president had not commented on Medvedev’s earlier post, but his Thursday midnight post appears to respond to the former Russian president’s “step towards war” remark. After pointing out that Russia and the U.S. do almost no business together, Trump said: “Let’s keep it that way, and tell Medvedev, the failed former President of Russia, who thinks he’s still President, to watch his words. He’s entering very dangerous territory!” Medvedev, who had not shied away from nuclear saber-rattling in the past few years, has not yet responded to Trump’s remarks.

Trump border czar Tom Homan ripped into a heckler on Saturday during remarks to the Turning Point USA Student Action Summit, saying the man doesn’t have “the balls” to serve his country among other things, in a video that went viral on social media.

Homan spoke at TPUSA’s event on Saturday about the immigration and enforcement policies of President Donald Trump and the administration, praising the courage of ICE agents in enforcing immigration laws, deriding criticism from Democrats, and expressing anger over repeated acts of violence against law enforcement carrying out the administration’s massive round-ups and deportations.

As he was speaking to the crowd, a voice shouted out asking Homan if he belongs to the ultra-violent drug gang MS-13.

The man who was shouting was holding a poster-sized manipulated image depicting Homan with an MS-13 tattoo on his knuckles, a clear reference to the case of Kilmar Abrego Garcia.

The heckler was dressed in MAGA gear, apparently using the MAGA gear as cover to get past security and into a position where he could make his protest.

Homan responded forcefully, to the delight of the crowd, and a clip of the moment went viral from several different accounts on X.

“Are you an MS-13 member? It says so–” the heckler shouted, getting drowned out by the crowd before the rest of the reference to the image he was holding could be heard.

“That’s okay! That’s okay!” Homan said. “I’ve got a question for you. Why don’t you come up here and hand me that picture? Bring it! Bring it! U-S-A! U-S-A!”

The crowd joined in on the chanting, and after a few seconds Homan continued.

“This guy wouldn’t know what it’s like to serve this nation. This guy ain’t got the balls to be an ICE Officer. He hasn’t got the balls to be a Border Patrol Agent,” Homan said as the crowd continued to cheer. “This guy lives in his mother’s basement – the only thing that surprises me, you don’t have purple hair and a nose ring. Get out of here, you loser!”

After another pause as the man was being escorted out by security, Homan added: “And you’re such a badass, meet me off stage in 13 minutes and 50 seconds. I guarantee you, he sits down to pee. Guaranteed.”

Homan remarked on sanctuary cities, saying they’ve told him he’s not welcome there but he goes anyway. He then addressed the heckler again.

“Assholes like this guy think they’re going to vilify men and women of ICE, that they’re gonna intimidate or scare us,” he said. “I’m not going anywheres, either is the men and woman of ICE. We’re gonna do the job that President Trump gave us to do.”

Did clueless Pugsley Homan have any idea how badly he was “owned” in that exchange?

A flock of Ice agents, some masked, some sporting military-operator fashion for show, smooshed the New York City comptroller, Brad Lander, up against a wall and handcuffed him in the hallway of a federal courthouse in early June, shuffling the mild-mannered politician into an elevator like the Sandman hustling an act off the stage 10 miles north at Harlem’s Apollo Theater.

Like at the Apollo, Lander’s arrest was a show. News reporters and cellphone camera-wielding bystanders crowded the hall to watch the burly federal officers rumple a 55-year-old auditor asking for a warrant.

Hannah Dugan, a Wisconsin judge, allowed a man to leave through the back doors of her courtroom, allegedly in response to the presence of immigration officers waiting to arrest him. FBI agents subsequently arrested Dugan in her Milwaukee courtroom on 25 April, charging her with obstruction.

The FBI director, Kash Patel, posted comments about her arrest on X almost immediately, and eventually posted a photograph of her arrest, handcuffed and walking toward a police cruiser, with the comment: “No one is above the law.” Digitally altered photographs of Dugan appearing to be in tears in a mugshot proliferated on social media. Trump himself reposted an image from the Libs of TikTok website of Dugan wearing a Covid-19 mask on the day of her arrest.

North Carolina Sen. Thom Tillis, 64, announced that he won’t seek re-election Sunday after President Donald Trump attacked him for not voting to advance his “big, beautiful bill.”

Trump directed his fury at Tillis after Senate Republicans narrowly voted to advance the MAGA figurehead’s sprawling spending package in a 51-49 vote Saturday night.

Tillis joined GOP Sens. Ron Johnson and Rand Paul with Democrats to vote against advancing the bill, enraging Trump and his followers, Al Jazeera reported.

NBC News: Pro-Palestinian activist Mahmoud Khalil released after months in detention

Minutes after the Columbia University activist was released, the Trump administration filed an appeal of his release.

Pro-Palestinian activist and Columbia University graduate student Mahmoud Khalil was released from detention Friday evening, ending more than three months of custody in a test of the executive branch’s power to unilaterally act against legal U.S. residents.

Assistant Homeland Security Secretary Tricia McLaughlin lashed out at “rogue” U.S. District Court Judge Michael Farbiarz, saying he had no authority to order Khalil’s release.

“This is yet another example of how out of control members of the judicial branch are undermining national security,” McLaughlin said. “Their conduct not only denies the result of the 2024 election, it also does great harm to our constitutional system by undermining public confidence in the courts.”

Government attorney Dhruman Sampat had argued that Congress has given the executive branch sweeping powers to determine who could be removed from the county.

The courts should not have the authority to interfere, Sampat said.

With regard to permanent residents, this presumed “authority” is total b*llsh*t!
