Cook County Courts Chief Judge Timothy Evans has barred Immigration and Customs Enforcement (ICE) from making courthouse arrests, citing concerns that detention has discouraged court appearances. The order has prohibited civil detention of parties, witnesses, and visitors. Immigrant groups claimed prior arrests have undermined trust in the justice system.

Cory Booker, Ed Markey and others urge Linda McMahon to step in amid violent crackdowns near Chicago schools

A group of Democratic senators have demanded that the Department of Education stop immigration enforcement activities from taking place close to schools, following several violent crackdowns near school grounds in Chicago.

Although the raids are conducted by Immigration and Customs Enforcement (ICE), which is under the Department of Homeland Security (DHS), the senators are making an appeal directly to the education secretary, Linda McMahon.

They said aggressive actions were affecting the safety of students.

“Federal agents continue to use unwarranted, excessive levels of force around Chicago, demonstrating an alarming lack of care or regard for the health and wellbeing of children, particularly by conducting unfocused, inflammatory operations within close proximity of school grounds,” the senators wrote, according to NBC News.

“We demand you pressure your colleague, secretary of homeland security Kristi Noem, to reinstate restrictions on federal immigration enforcement operations in and around places of education.”

Illinois Gov. J.B. Pritzker signed an executive order Thursday authorizing the creation of an accountability commission after the deployment of federal officers to the state.

At a news conference, Pritzker announced the creation of the Illinois Accountability Commission, dedicated to “truth, transparency and justice.” Tensions have risen in the state as demonstrators call for more accountability from Immigration and Customs Enforcement officers.

“I am angry because this is not the country that I want for us,” Pritzker said. “This is not the country that any of us thought that we were living in. And yet here it is, nine months into an administration, I wish we didn’t have to do this. Can you imagine that we have to do this in this country?”

Pritzker said the commission will have three core missions: Creating a public record of the alleged abuses, capturing the impact on families and communities and recommending actions to prevent further harm and to pursue justice.

Alternet: Trump gets bad news from one of his own appointed Supreme Court justices

Not long after losing his bid to deploy the U.S. military in Illinois at the U.S. Circuit Court level, President Donald Trump asked for help from the Supreme Court of the United States (SCOTUS). But he’s already running into difficulty in the form of one of his own appointed justices.

Politico legal correspondent Josh Gerstein reported Friday that while the Court has agreed to hear Trump’s case and has given the State of Illinois a deadline of 5 PM on Monday to respond to Trump, there’s a catch: According to Gerstein, Justice Amy Coney Barrett declined Trump’s request of an administrative stay of a lower court order preventing him from deploying troops in Illinois borders.

In legal parlance, a higher court can “stay” a lower court’s order — meaning pause it while litigation plays out — if a complainant asks for one. However, the 6-3 conservative supermajority on the Supreme Court not granting Trump his stay means that his administration will be unable to have federal troops patrolling the streets of America’s third-largest city.

Macon Telegraph: Lawsuit Alleges ICE Detains U.S. Residents

Department of Homeland Security (DHS) Secretary Kristi Noem participated in an enforcement operation in Illinois, leading to multiple detentions and arrests related to Operation Midway Blitz. Advocates argued the operations could unfairly target U.S. citizens and impact mixed-status families. DHS has confirmed the five arrests.

Noem said, “President Trump has been clear: if politicians will not put the safety of their citizens first, this administration will.” She added, “Just this morning, DHS took violent offenders off the streets with arrests for assault, DUI, and felony stalking. Our work is only beginning.”

DHS Assistant Secretary Tricia McLaughlin said, “On August 28, ICE arrested Nathaniel Rojas, a criminal alien from the Dominican Republic. His criminal history includes convictions for felony grand larceny, felony aggravated DUI with a child passenger less than 16 years old, identity theft, and retail theft. This criminal alien is in ICE custody pending removal proceedings.”

Critics said many detainees had no criminal record, citing federal data, and argued the administration’s focus on high arrest totals raises due process concerns.
