A recent decision by the court shows just how done it is with the Trump administration’s failure to obey its orders in Alien Enemies Act cases

Early Friday evening, the Supreme Court issued a pointed decision in the case of a group of Venezuelan detainees who previously faced the imminent risk of being sent to a notorious prison in El Salvador by the Trump administration. In addition to rejecting the administration’s choice to give these detainees only 24 hours notice of their removal, the decision answered a question indirectly posed in the case. Is the highest court in the nation sick of the Trump administration’s bullshit?

The answer, the decision states rather definitively, is yes — at least in immigration cases involving removals under the Alien Enemies Act.

In an eight-page unsigned decision, with only Justices Samuel Alito and Clarence Thomas dissenting, the court firmly rejected how the administration has been using the Alien Enemies Act to quickly remove Venezuelan and Salvadoran immigrants with little to no due process while also effectively calling the administration liars, in so many words.

Judge Keith Ellison in Texas gave the federal government 24 hours to confirm the location of Widmer Josneyder Agelviz Sanguino, 24, and 48 hours to “restore and help maintain attorney-client communication” with him, NBC News reported.

Last month, President Donald Trump shared an edited image of the knuckles of Kilmar Abrego Garcia, a Maryland resident with protected status wrongfully sent to a Salvadoran detention facility. The photo showed “MS13” apparently added above his knuckle tattoos, even though other photos of his hand did not have that text. Last week, I had a chance to ask Homeland Security Security Kristi Noem [Bimbo #2] if she had investigated how an edited image came into the president’s hands. Not only did she refuse to answer, she barely acknowledged that the image was edited.

The groundwork for jailing the innocent is being laid right now — not behind closed doors, but out in the open.

First, Trump appointed Kash Patel as FBI director, an unqualified podcaster who published a book listing names of Trump’s enemies who should be imprisoned. I didn’t make the top 60; rather, I was mentioned in the foreword to Patel’s list as a legislator who should be targeted.

Next, in Trump’s first hours as president, rather than issuing executive orders that would lower consumer costs, he pardoned or commuted the sentence of every Jan. 6 criminal. A man willing to free hundreds of political allies seems more than willing to jail his political enemies.

Accordingly, last month, Trump directed his attorney general to investigate Christopher Krebs, former head of the Cybersecurity and Infrastructure Security Agency, and Miles Taylor, former chief of staff at the Department of Homeland Security. Krebs made the mistake of declaring the 2020 election the most secure in history. Taylor had the courage to organize other concerned Trump national security officials to bring to light Trump’s constitutional crimes.

And Trump demonstrated he’s willing to tell any lie to justify jailing anyone — which brings us back to Abrego Garcia. In April, the Trump administration admitted in court that it had mistakenly sent Abrego Garcia to El Salvador.

Every court that’s heard Abrego Garcia’s appeal — including the Supreme Court — has ordered Trump to facilitate his return to the United States. When asked about the case, Trump boasted he “could” return Abrego Garcia, but he “won’t.” To justify the man’s imprisonment, Trump has pointed to the altered image.

Independent: Trump endorses idea that Supreme Court ruling blocking his deportations under Alien Enemies Act is ‘illegal’

President reposted a comment claiming the Supreme Court was heading down the wrong path by blocking some of Trump’s actions

President Donald Trump endorsed the idea that the United States Supreme Court had placed an “illegal injunction” on him by temporarily blocking his administration’s ability to deport Venezuelans, accused of being gang members, without due process, while litigation on the matter plays out in lower courts.

On Truth Social on Saturday, Trump reposted two posts made by attorney Mike Davis, a close Trump ally and the founder of the Article III project, calling the court’s recent decision “illegal” and claiming it was “heading down a perilous path” by not allowing Trump to continue a constitutionally questionable action.

“The Supreme Court still has an illegal injunction on the President of the United States, preventing him from commanding military operations to expel these foreign terrorists,” Davis wrote.

The president is not taking the Supreme Court’s rejection of his immigration plan well.

President Donald Trump is raging against the Supreme Court after it temporarily blocked his administration from using a centuries-old wartime law to fast-track migrant deportations. On Saturday, the president ramped up his attacks by highlighting a plan to move “terrorists” near justices’ homes.

“The president should release these terrorists near the Chevy Chase Country Club, with daytime release,” former GOP staffer Mike Davis wrote online. Trump shared the post.

The Maryland country club referenced reportedly counts Chief Justice John Roberts and Associate Justice Brett Kavanaugh among its members. Former Obama speechwriter Jon Favreau entered the online fray by summarizing the madness:

“The President re-posts a suggestion from an advisor that he release ‘terrorists’ near the homes of Supreme Court justices who’ve merely ruled that the government can’t send people to a foreign gulag without due process.”

Trump is deranged.

MSNBC: Supreme Court says Trump needs to give more notice in Alien Enemies Act deportations

The court previously granted Texas detainees emergency relief, over dissent from Justices Samuel Alito and Clarence Thomas.

The Supreme Court on Friday extended its block on the Trump administration’s ability to immediately deport a group of migrants in Texas under the Alien Enemies Act.

The court had already blocked such deportations in a previous order and, in Friday’s ruling, said more notice before carrying out deportations is needed, sending the case back to the lower court for further litigation. The court did not decide the underlying question of Trump’s use of the wartime act to carry out deportations.

Raw Story: Judge hits Trump admin with sharply worded threat over ‘intentional refusal to comply’

The Trump Department of Justice faces a new legal deadline after a federal judge warned that its failure to comply with a court order could be treated as an “intentional refusal” to follow the law.

In a sharply worded one-page order, U.S. District Judge Paula Xinis said the Justice Department missed a key deadline to produce a privilege log tied to its claims of the state secrets privilege in the case of Kilmar Abrego Garcia, the Salvadoran national wrongfully deported to the country in March.

“Evidently missing from the defendants’ filing is the privilege log that this court ordered to be produced,” Xinis wrote in the document posted by Politico’s Kyle Cheney. The judge gave the government a Tuesday afternoon deadline to file the log and delivered a warning.

“Failure to file the privilege log or otherwise respond will be construed as an intentional refusal to comply with this court’s orders,” according to the order. The dispute bubbled up last week after the Trump administration invoked the state secrets privilege to shield details surrounding Abrego Garcia’s case, according to a report in Politico.

The judge set the next in-person hearing for Friday.

As a candidate he promised a “massive” crackdown. But since taking office his actions, though designed to be as frightening as possible, have fallen far short of that.

A desperate family, rushing their sick child to a Texas hospital, is forced back into Mexico… And a young Salvadoran, Kilmar Abrego Garcia, becomes one of the best known of millions of migrants, receiving his Maryland senator while remaining imprisoned—uncharged, untried in the US or in his homeland.

The Trump administration has shown it is willing to test both public tolerance and long-established legal principle. It has repeatedly labeled millions of undocumented residents of the United States “terrorists” and “criminals.” Homeland Security Secretary Kristi Noem and “border czar” Tom Homan use exaggerated threats to create a country where an almost entirely law-abiding population—of construction workers, hotel cleaners, home healthcare workers—can be treated with brutality and summary justice.

Throughout his 2024 campaign, Donald Trump promised a swift and enormous federal effort to round up and deport millions of people living long-term in America. Signs calling for “Mass Deportation” were held up in cheering crowds at Trump rallies all over the country. Meeting almost no resistance or reply from Democratic candidates for high office, Republicans were able to define the battlefield, equating millions of workers, students, and homemakers scattered across American communities with cartel drug mules, rapists, and members of the notorious MS-13 gang.

Politico: Judges have a warning about Trump’s rapid deportations: Americans could be next

A fundamental promise by America’s founders — that no one should be punished by the state without a fair hearing — is under threat, a growing chorus of federal judges say.

That concept of “due process under law,” borrowed from the Magna Carta and enshrined in the Bill of Rights, is most clearly imperiled for the immigrants President Donald Trump intends to summarily deport, they say, but U.S. citizens should be wary, too.

Across the country, judges appointed by presidents of both parties — including Trump himself — are escalating warnings about what they see as an erosion of due process caused by the Trump administration’s mass deportation campaign. What started with a focus on people Trump has deemed “terrorists” and “gang members” — despite their fierce denials — could easily expand to other groups, including Americans, these judges warn.

“When the courts say due process is important, we’re not unhinged, we’re not radicals,” U.S. District Judge Ana Reyes, a Washington, D.C.-based appointee of President Joe Biden, said at a recent hearing. “We are literally trying to enforce a process embodied in probably the most significant document with respect to peoples’ rights against tyrannical government oppression. That’s what we’re doing here. Okay?”

It’s a fight that judges are increasingly casting as existential, rooted in the 5th Amendment’s guarantee that “no person shall … be deprived of life, liberty or property, without due process of law.” The word “person,” courts have noted, makes no distinction between citizens or noncitizens. The Supreme Court has long held that this fundamental promise extends to immigrants in deportation proceedings. In a 1993 opinion, Justice Antonin Scalia called that principle “well-established.”

Gang experts say the tattoos on Kilmar Abrego Garcia’s knuckles are unlikely to signify gang membership. The president says otherwise.

Mendacious King Donald used an altered photo in his claim that Kilmar Abrego Garcio had MS-13 tattoos:

President Trump has claimed that Kilmar Abrego Garcia, the man mistakenly deported to El Salvador in March, is a member of MS-13, the Salvadoran-American criminal gang, and that the tattoos on Mr. Abrego Garcia’s knuckles prove it.

In a post nearly three weeks ago on Truth Social, Mr. Trump’s social media platform, he gave his version of a primer on those tattoos, showing a photo of Mr. Abrego Garcia’s hand, with one small tattoo on each finger: a marijuana leaf, a smiley face with X’s for eyes, a cross and a skull.

Above each of those black tattoos was a letter or a number — M, S, 1 and 3 — in a sans-serif font that clearly had been superimposed onto the photo. “He’s got MS-13 tattooed onto his knuckles,” the president wrote in his post.

In other photos, however, including ones shared by Mr. Abrego Garcia’s wife, Jennifer Vasquez Sura, the letters and numbers do not appear on Mr. Abrego Garcia’s knuckles.
