The Federal Reserve governor’s job is safe for now.

Donald Trump was hit with a legal smackdown after trying to remove Federal Reserve governor Lisa Cook.

Cook can stay in her job, a federal judge ruled in Washington, D.C., blocking Trump’s unprecedented attempt to boot her using allegations of mortgage fraud.

She will now be present at the Fed’s Sept. 16 meeting, but Cook’s trouble with Trump is not yet over.

“President Trump has not identified anything related to Cook’s conduct or job performance as a board member that would indicate that she is harming the board or the public interest by executing her duties unfaithfully or ineffectively,” U.S. District Judge Jia Cobb said after issuing a preliminary injunction.

The judge also ruled that removing Cook caused her “irreparable harm” and that the president had likely violated her procedural right to due process by posting his letter to her on social media.

The Daily Beast has contacted the White House and the Federal Reserve for comment.

Trump posted a public termination letter on his Truth Social account last month, addressed to Cook, who was confirmed by the Senate in 2022 as the first Black woman to serve as a Federal Reserve governor.

His post contained allegations that Cook had committed mortgage fraud, claims that predated her time on the board, and said she was being removed from her position “effective immediately.”

At the time, Cook released her own statement, claiming Trump had “no authority” to fire her. She added, “I will not resign. I will continue to carry out my duties to help the American economy as I have been doing since 2022.”

Cook hired lawyer Abbe Lowell, who said in a statement last month that Trump’s “demands lack any proper process, basis or legal authority” and they would take whatever actions were necessary to prevent “his attempted illegal action.”

Governors can only be removed by a president with a valid reason for termination, known as “for cause.” Otherwise, they serve in long, fixed roles to add to financial stability. Cook, who was nominated to the post by Joe Biden, is not due to finish her current term until 2038.

The preliminary injunction Judge Cobb granted on Tuesday also found that Trump had likely violated the Federal Reserve Act by using social media to air his allegations about her mortgage fraud and also to fire her in public.

“The court is highly doubtful that Cook should have been required to piece together the evidentiary basis for a ‘for cause’ removal from a scattered assortment of social media posts and news articles,” Cobb wrote. “Even if the notice provided had been sufficient, Cook’s due process rights were nevertheless likely violated because she was not given a ‘meaningful opportunity’ to be heard.”

Cobb also barred Reserve Chair Jerome Powell or Fed officials from carrying out Trump’s wishes of firing Cook.

“This ruling recognizes and reaffirms the importance of safeguarding the independence of the Federal Reserve from illegal political interference,” Cook’s counsel Lowell said in a statement.

“Allowing the president to unlawfully remove Governor Cook on unsubstantiated and vague allegations would endanger the stability of our financial system and undermine the rule of law.”

He added, “Governor Cook will continue to carry out her sworn duties as a Senate-confirmed Board Governor.”

Trump did not answer a reporter’s question about a court overruling his firing when he was leaving a seafood dinner on Tuesday.

However, White House deputy press secretary Kush Desai told Politico that Trump’s firing of Cook was “lawful” and boosted accountability for the body that sets interest rates.

“The president determined there was cause to remove a governor who was credibly accused of lying in financial documents from a highly sensitive position overseeing financial institutions,” Desai said.

“The removal of a governor for cause improves the Federal Reserve board’s accountability and credibility for both the markets and American people.”

Judge Cobb’s ruling said this was the first purported “for cause” removal of a governor in the 111-year history of the Federal Reserve.

In her finding, Cobb said Trump’s attempt to remove Cook “was done in violation” of the “for cause” provision.

She said the best reading of that provision was that it was limited to “actions relating to that governor’s ‘behavior in office.’” And because the allegations of mortgage fraud occurred before Cook’s role as governor, Cobb said that “for cause” did “not contemplate removing an individual purely for conduct that occurred before they began in office.”

Trump has also attempted to fire Powell this year, unhappy with his refusal to cut interest rates.

The Dispatch: No, President Trump’s Tariffs Haven’t Generated $8 Trillion in Revenue

On Labor Day, a post on the White House’s official X account lauded President Donald Trump for having generated $8 trillion in revenue for the federal government and celebrated his “protectionist trade policies” for creating $8 trillion in U.S. investment. The text of the post highlights the trade policies, while an accompanying graphic touts the tariff revenue.

Trump also claimed Tuesday that the U.S. has “taken in almost $17 trillion in investment … most of it has come in because of tariffs.”

None of the claims is accurate.

A Bipartisan Policy Center analysis of the Treasury Department’s daily statements shows that the federal government has taken in $158.4 billion in tariff revenue since January 21, the day after Trump’s inauguration. On August 22, the Congressional Budget Office updated past projections and now estimates that Trump’s tariffs on China, Mexico, and several other countries will reduce deficits by $4 trillion—over the next decade. Each year, the United States on average takes in $3 trillion in imported goods, which makes the claim of $8 trillion in tariff revenue just in 2025 nearly impossible. 

The White House maintains on its website a list of pledges of investment by various companies and countries, most recently updated on September 2. The list includes private sector projects such as a “$600 billion investment in U.S. manufacturing and workforce training” by Apple, $500 billion by Nvidia to update its U.S. infrastructure, and $200 billion by Micron to boost its U.S. production of memory chips. And it includes pledges by foreign nations such as the United Arab Emirates ($1.4 trillion), Qatar ($1.2 trillion), and Japan ($1 trillion) to invest in the U.S. 

Add up those amounts, and you get roughly $7.5 trillion. But there are several reasons not to take these pledges at face value. As Dispatch contributor and Cato Institute vice president Scott Lincicome has written, companies like Apple, Amazon, or the chip manufacturer TMSC often seek to gain favor with a new administration by promising multibillion-dollar investments. These often involve either expansions of projects already in the works or vague pledges that lack concrete time frames. 

“Oftentimes companies that are actually pledging new investment will say they’re going to do it based on market conditions,” Lincicome told The Dispatch. “Well, market conditions change, and suddenly what looks like a good investment isn’t a good investment, and it never happens. Or, the timeline is hilariously drawn out, and so it might take 10 years to hit that number.”

Trump’s first term, Lincicome continued, featured a collection of multibillion-dollar pledges from manufacturing giants—ultimately, with mixed successes. “Some of it certainly happened, but a lot of it didn’t, and some of it that did happen actually ended up collapsing. Look at [Magnitude] 7 Metals, this big aluminum company. [Trump trade adviser] Peter Navarro went out there and claimed this was the future of American aluminum, and it’s closed down two years later.”

When asked to clarify, the White House did not offer further explanation for their Labor Day post or for Trump’s remarks. 

“President Trump is right: tariffs are bringing in historic revenue for the federal government, revenue that will amount to trillions of dollars in the coming years,” White House spokesperson Kush Desai told The Dispatch in an email. “Tariffs made America rich once before, and tariffs will Make America Wealthy Again.”

Simply bullshit! “The federal government has taken in $158.4 billion in tariff revenue since January 2”, not $8 trillion. Liars!

And they probably haven’t taken into account the changes in spending habits that occur when taxes and prices increase.

CNBC: Most Trump tariffs ruled illegal in blow to White House trade policy

A federal appeals court ruled Friday that most of President Donald Trump‘s global tariffs are illegal, striking a massive blow to the core of his aggressive trade policy.

The U.S. Court of Appeals for the Federal Circuit in a 7-4 ruling held that the law Trump invoked when he granted his most expansive tariffs does not actually grant him the power to impose those levies.

Trump is all but certain to appeal the ruling to the Supreme Court. The appellate court paused its ruling from taking effect until Oct. 14, in order to give the Trump administration time to ask the Supreme Court to take up the case.

The White House did not immediately respond to CNBC’s request for comment on Friday’s ruling, which is the second straight loss for Trump in the make-or-break case.

The Trump administration has argued that the International Emergency Economic Powers Act, or IEEPA, empowers the president to effectively impose country-specific tariffs at any level if he deems them necessary to address a national emergency.

The U.S. Court of International Trade in late May rejected that stance and struck down Trump’s IEEPA-based tariffs, including his worldwide “reciprocal” tariffs unveiled in early April. But the Federal Circuit quickly paused that ruling while Trump’s appeal played out.

Associated Press: Whitmer told Trump in private that Michigan auto jobs depend on a tariff change of course

Michigan Gov. Gretchen Whitmer met privately in the Oval Office with President Donald Trump to make a case he did not want to hear: the automotive industry he said he wants to save were being hurt by his tariffs.

The Democrat came with a slide deck to make her points in a visual presentation. Just getting the meeting Tuesday with the Republican president was an achievement for someone viewed as a contender for her party’s White House nomination in 2028.

Whitmer’s strategy for dealing with Trump highlights the conundrum for her and other Democratic leaders as they try to protect the interests of their states while voicing their opposition to his agenda. It’s a dynamic that Whitmer has navigated much differently from many other Democratic governors.

The fact that Whitmer had “an opening to make direct appeals” in private to Trump was unique in this political moment, said Matt Grossman, a Michigan State University politics professor.

It was her third meeting with Trump at the White House since he took office in January. This one, however, was far less public than the time in April when Whitmer was unwittingly part of an impromptu news conference that embarrassed her so much she covered her face with a folder.

On Tuesday, she told the president that the economic damage from the tariffs could be severe in Michigan, a state that helped deliver him the White House in 2024. Whitmer also brought up federal support for recovery efforts after an ice storm and sought to delay changes to Medicaid.

Trump offered no specific commitments, according to people familiar with the private conversation who were not authorized to discuss it publicly and spoke only on condition of anonymity to describe it.

Whitmer is hardly the only one sounding the warning of the potentially damaging consequences, including factory job losses, lower profits and coming price increases, of the import taxes that Trump has said will be the economic salvation for American manufacturing.

And the odds that King Donald will actually give due consideration to intelligent advice from a Democrat — not to mention a female Democrat — are … zero?

The Trump administration is considering cutting federal education funds to California, according to people familiar with the administration’s thinking. The discussion comes as Gov. Gavin Newsom and President Donald Trump feud over the president’s deployment of the National Guard to LA to stop immigration protests.

A Trump administration employee, who was not permitted to speak publicly about the administration’s plans, told POLITICO the Education Department may stop the disbursement of “formula funds,” which are awards based on a predetermined formula created by Congress. The administration has not yet reached a decision, according to a separate person familiar with the discussions. The timing for a potential decision is also not finalized.

“That is one of the tools and the opportunities that we have with California,” Education Secretary Linda McMahon said of the potential to pull the state’s funds on Tuesday at an event hosted by Bloomberg News. “And I think it’s right that we make them aware that that is a risk that they run.”

Associated Press: NIH scientists publish declaration criticizing Trump’s deep cuts in public health research

In his confirmation hearings to lead the National Institutes of Health, Jay Bhattacharya pledged his openness to views that might conflict with his own. “Dissent,” he said, ”is the very essence of science.”

That commitment is being put to the test.

On Monday, scores of scientists at the agency sent their Trump-appointed leader a letter titled the Bethesda Declaration, challenging “policies that undermine the NIH mission, waste public resources, and harm the health of Americans and people across the globe.”

It says: “We dissent.”

In a capital where insiders often insist on anonymity to say such things publicly, 92 NIH researchers, program directors, branch chiefs and scientific review officers put their signatures on the letter — and their careers on the line. An additional 250 of their colleagues across the agency endorsed the declaration without using their names.

The letter, addressed to Bhattacharya, also was sent to Health Secretary Robert F. Kennedy Jr. and members of Congress who oversee the NIH. White House spokesman Kush Desai defended the administration’s approach to federal research and said President Donald Trump is focused on restoring a “Gold Standard” of science, not “ideological activism.”

In other words, screw the experts and follow the lead of Robert “Brainworm” Kennedy, Jr.

The American Revolution was a result of the tyranny experienced by colonists under the British monarchy. Many Americans had fled from Europe where they had been persecuted under the rule of powerful monarchs. The government produced by the revolution was designed to ensure no such tyranny could be reproduced in the newly formed United States.

The framers of the constitution created a checks-and-balances system of government to ensure that no single branch of the federal government (executive, judicial or legislative) could dominate the others. Each branch has powers to curtail or empower the others.

However, some Americans are concerned about a return of absolute rule due to the steps taken by Donald Trump’s second administration. This has sparked around 100 “no kings” protests all over the US, organised to coincide with Trump’s birthday on June 15.

Independent: White House backed down on China’s tariff after president was told they would hurt ‘Trump’s people’ the most

Several White House staffers had to warn the president that his tariffs would impact ‘Trump’s people.’

The White House eased tariffs imposed on China after several staffers were forced to warn President Donald Trump that his penalties would cause his supporters – or “Trump’s people,” – to suffer economically, according to a report.

While Trump was reluctant to lower tariffs against Beijing too quickly, several White House staffers – including Chief of Staff Susie Wiles, Treasury Secretary Scott Bessent and other aides – warned him the penalties were placing his own supporters in danger, sources told the Washington Post.

“The key argument was that this was beginning to hurt Trump’s supporters – Trump’s people,” one person briefed on the talks said. “It gave Susie a key window.”
