San Francisco Chronicle: S.F. judge blocks Trump administration from ending legal status for Venezuelans and Haitians

President Donald Trump’s administration is illegally seeking to deport hundreds of thousands of Venezuelans and Haitians to their conflict-stricken nations, a federal judge in San Francisco ruled Friday.

The people affected by the ruling have been living in the United States under temporary protected status, or TPS, granted to undocumented immigrants with no serious criminal record who would be endangered by war, natural disasters or other conditions in their homeland. Trump opposes TPS and contends it has been used to protect members of criminal gangs.

But U.S. District Judge Edward Chen said removing the protections from Venezuelans and Haitians would return them to “conditions that are so dangerous that even the State Department advises against travel to their home countries.”

“For 35 years, the TPS statute has been faithfully executed by presidential administrations from both parties, affording relief based on the best available information obtained by the Department of Homeland Security in consultation with the State Department and other agencies, a process that involves careful study and analysis,” the judge wrote. “Until now.”

He did not say how many immigrants were covered by the ruling, but advocacy groups said it would protect hundreds of thousands from each nation. Chen had previously halted the deportation of 350,000 Venezuelans with TPS status, but the Supreme Court froze his order in May and allowed the administration to seek their deportation.

Friday’s ruling “provides immediate relief to several hundred thousand Venezuelans who should not have been subjected to this lawless policy in the first place,” said their attorney, Ahilan Arulanantham, a UCLA law professor. “Sadly, today’s ruling comes too late for many Venezuelans who were detained and deported under that policy because the Supreme Court allowed it to take effect without giving any reasons. We are hopeful the rule of law will now prevail.”

In Friday’s decision, Chen said Trump’s Homeland Security secretary, Kristi Noem, terminated TPS for both groups of migrants as soon as she took office, with “no meaningful review,” reversing extensive findings and decisions by her predecessors. He said it was the first such action in the program’s 35-year history.

The judge said Noem had made unfounded assertions that “Venezuela didn’t send us their best” but instead sent “criminals.” She referred to Venezuelan migrants as “dirtbags” in a Jan. 29 Fox News interview. Chen also cited Trump’s campaign claims that Haitian migrants were eating household pets in Ohio.

Such statements are evidence that the administration’s actions were “based on racial, ethnic, and/or national origin animus,” said Chen, who was appointed to the court by President Barack Obama.

Associated Press: Trump signs order to designate nations that hold Americans as sponsors of wrongful detention

President Donald Trump signed an executive order on Friday that would let the U.S. designate nations as state sponsors of wrongful detention, using the threat of associated sanctions to deter Americans from being detained abroad or taken hostage.

CNN: US considers banning Iranian diplomats from shopping at Costco during UN meeting

… The movements of Iranian diplomats are severely limited in New York, but one proposal being floated would bar them from shopping at big, members-only wholesale stores like Costco and Sam’s Club without first receiving the express permission of the State Department.

Such stores have been a favorite of Iranian diplomats posted to and visiting New York because they are able to buy large quantities of products not available in their economically isolated country for relatively cheap prices and send them home.

It was not immediately clear if or when the proposed shopping ban for Iran would take effect, but the memo said the State Department also was looking at drafting rules that would allow it to impose terms and conditions on memberships in wholesale clubs by all foreign diplomats in the US….

So what’s to stop them from pre-ordering a shitload of stuff from Amazon and having it delivered to their hotel?

Being so mean and petty seems pointless to me. It only reinforces the idea we are enemies. Smother them with kindness and let them go shopping, and you might change their impressions of the United States.

Newsweek: ICE detains dad who entered US with green card 50 years ago—Family

Ahusband and father of four from Michigan who arrived in the United States over 50 years ago on a green card has been in U.S. Immigration and Customs Enforcement (ICE) detainment for nearly a month, according to the man’s family.

Newsweek reached out via email to ICE and the Department of Homeland Security via email for comment.

Why It Matters

Nael Shamma, a 58-year-old Palestinian from Burton, Michigan, was getting his wife, Christina, a cup of coffee when an unmarked car reportedly pulled in front of the family’s home and took him into custody, according to Flint news station ABC12.

Shamma’s detention sparks questions about the Trump administration’s wide-ranging immigration crackdown, which has included apprehending both criminals and non-violent offenders alike. ICE and DHS have remained adamant that immigrants who possess a green card are provided “a privilege, not a right,” and that the government has the authority to revoke a green card if laws are broken or abused.

What To Know

An ICE spokesperson told The Detroit News that Shamma “has a two-decade-long rap sheet” that includes breaking and entering, armed violence and aggravated battery.

“He freely admitted to ICE officers he ‘ran’ with the Latin Kings street gang in Chicago in the 1980s and has had a final order of removal since 1989,” they said.

Christina Shamma stated that her husband has resided in the U.S. for over five decades and has consistently complied with reporting requirements. His green card was revoked in his 20s when he went to prison for assault, resulting in annual check-ins since 2012, according to The Detroit News.

“He was ordered to report once a year,” she told ABC12. “He just reported in May. They told him everything was fine.”

Nael has been held at The North Lake Processing Center in West Michigan.

Shamma’s niece, Sara Haddad, told The Detroit News that ICE attempted and failed to deport him in 2012 after Israeli officials wouldn’t sign off. Shamma was born in Jerusalem one year before Israel took control of the city, effectively leaving him “stateless,” according to news outlet MLive.

Haddad said that she is fearful that her uncle will be deported to Gaza. Sending him to the wartorn area “would be sending him to death,” she said.

“It’s been very, very hard on everyone,” she told The Detroit News. “We love him so much, and he really helps take care of everyone.”

Newsweek reached out to Haddad via email for comment.

Haddad is listed as the petitioner on both a Change.org petition for Shamma and a GoFundMe that has raised more than $3,400 from 51 donations as of Thursday morning.

The pages state that Shamma is the third oldest of seven siblings, came to the U.S. at the age of 9, and has four children and two grandchildren. He’s described as “a hardworking man” who provides for his family and the “kind of person who doesn’t wait to be asked for help.”

“He is a proud American, even if the government hasn’t always seen him that way,” the Change.org petition reads. “He pays his taxes. He contributes to his community. He comes home to his two dogs, plays with his grandkids, and tries to be the best man he can be. And yet, ICE ripped him from his family without warning.

“They came to his home—a home he worked hard to earn—and took him away from the people who love and depend on him. There was no crime, no threat, no reason for such cruelty. Just a sudden, violent separation that has left his children, wife and elderly parents reeling. One moment he was feeding the dogs. The next, he was gone.”

Macon Telegraph: Trump Suffers Legal Blow Over Travel Ban

U.S. District Judge Sparkle Sooknanan has ruled that the State Department may not use the Trump-era travel ban to deny immigrant visas to applicants whose cases were placed on hold under the policy. The administration has claimed judicial overreach, while immigration attorneys have urged a less restrictive review. The ruling directs the State Department to process affected visas without invoking the ban.

Immigration attorney Curtis Morrison stated, “Now, let’s hope when it’s time for the Trump administration to review the ban at the 90-day mark they do that in good faith, and it leads to a less restrictive ban that will allow plaintiffs with issued immigrant visas to immigrate the US and start their lives here.”

State Department spokesperson Tommy Pigott said, “Another example of wrongful judicial overreach aimed at curtailing this Administration’s strong and unwavering efforts to keep Americans and our communities safe.”

Let me fix that for you: You’ll continue your strong and unwavering efforts to abuse immigrants and to make a mockery of the rule of law.

Pigott added, “We will continue to relentlessly work to ensure the President of the United States is able to use every tool he has available, including visas, to finally bring oversight to who we allow to visit our country.”

Sooknanan noted that the legal framework for the travel ban does not allow the State Department to reject visas outright. The Trump administration has maintained the measures are necessary for national security.

Sooknanan wrote, “That provision authorizes the President, subject to specified limitations, to ‘suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.’”

U.S. Customs and Border Protection (CBP) retains authority to deny entry to visa holders, further limiting immigration options. The State Department is now under pressure to process applications prior to the September 30, 2025 fiscal deadline.

Africa News: Senegal slams U.S. sanctions on ICC prosecutor

Senegal has expressed solidarity with the International Criminal Court, and urged the United States to lift sanctions against the tribunal and its officials.

In a statement, the foreign ministry criticized Washington’s sanctions as an attack on the independence of the court, and the mandate of its officials.

The State Department on Wednesday announced new sanctions on four ICC officials, including two judges and two prosecutors, for pursuing investigations into American and Israeli officials suspected of committing war crimes.

One of those sanctioned is Mame Mandiaye Niang, a Senegalese national who works as a prosector at the ICC.

Senegal’s prime minister Ousmane Sonko has also voiced support for Niang, praising his ‘dedication to justice’.

The US already sanctioned the court and chief prosecutor Imran Khan for seeking arrest warrants against the Israeli prime minister and the defense minister for suspected war crimes in Gaza last November.

The measures by Washington have crippled the court’s work, and scared away collaborators, suppliers and contractors.

The International Court of Justice has ruled that Israel was plausibly committing genocide in Gaza.

Rolling Stone: Trump Cuts Off Medical Visas from Gaza After Laura Loomer Meltdown

The move comes after Loomer, the right-wing provocateur, freaked out over a video of children from Gaza coming to the U.S. for medical care

Donald Trump’s administration stopped all visitor visas from Gaza — including those for humanitarian and medical aid — on Saturday after far-right provocateur and Trump friend Laura Loomer posted about several Palestinian children being allowed into the U.S. for medical care amid Israel’s relentless siege and blockade. 

The State Department said it will “conduct a full and thorough review of the process and procedures used to issue a small number of temporary medical-humanitarian visas in recent days,” in a post on X

“It’s amazing how fast we can get results from the Trump administration,” Loomer wrote on X, adding an applause emoji.”

Loomer posted a video Friday showing children from Gaza arriving in San Francisco for treatment, greeted by a cheering crowd. Loomer called the video an “exclusive,” posting it to X with her watermark on it, despite it being posted on Aug. 6 by the nonprofit HEAL Palestine, which provides medical care to Palestinians

“How did Palestinians get Visas under the Trump administration to get into the United States? Did @StateDept approve this? How did they get out of Gaza? Is @SecRubio aware of this?” she asked Friday

The caption of the Aug. 6 video reads, “Leyan, Ghazal, and their siblings will [begin] medical treatment and school as soon as possible under the care of HEAL.”

Loomer messages Rolling Stone on Saturday afternoon: “The MAGA base didn’t vote for more Islamic immigration into the United States. I applaud Secretary of State Marco Rubio for halting the Visas of Gazans from a HAMAS hot zone and look forward to seeing the State Department’s review of the rogue State Department employees who signed off on visas for Gazans who have shown a disrespect for American life as Hamas continues to hold hostages.”

According to NBC Bay Area, Leyan is a 14-year-old who was burned and injured by shrapnel in an explosion at her school. Ghazal, 6, was also hurt in an explosion. Another child who arrived, 8-year-old Anas, was hurt in an explosion that killed his entire family. There were 11 children in total evacuated, the largest medical evacuation of injured children from Gaza to the U.S.

“The logistics of getting them out is also a nightmare,” Talha Baquar of HEAL Palestine told NBC Bay Area. “The Israeli government has to approve of their release. One of the children who’s coming today, he’s been on a waitlist to get out. He’s had his medical visa since November of last year.”

“These children could not wait,” Dr. Zeena Salman, pediatric oncologist and co-founder of HEAL Palestine, said in a statement. “Their lives are at stake, and this mission is about giving them a future.”

After the children receive medical care, they will go to Egypt, where HEAL will continue to support them, the organization said. HEAL has evacuated 63 injured children and 148 people total as of August 4, according to its website.

Andrew Miller, former U.S. Deputy Assistant Secretary of State for Israeli-Palestinian Affairs, posted on X that the State Department’s move reflected “prejudice.” 

“I dealt with such cases during the Biden admin. No one leaves Gaza w/o Israel’s approval & everyone’s vetted through U.S. databases. Any security risk is negligible. This is rank ethnic/religious prejudice. Denying sick people critical medical care is cowardly & depraved.”

Loomer declared victory after the State Department announced it would stop visas from Gaza.

“This is fantastic news,” she posted on X. “Hopefully all GAZANS will be added to President Trump’s travel ban. There are doctors in other countries. The U.S. is not the world’s hospital!”

“Thank you for bringing attention to this matter, @LauraLoomer,” Jan. 6 rally organizer Caroline Wren wrote on X

Islamophobic Rep. Randy Fine (R-Fla.) applauded Loomer for posting the video. “Massive credit needs to be given to @LauraLoomer for uncovering this and making me and other officials aware. Well done, Laura,” he posted on X

The Council on American-Islamic Relations (CAIR) said in a statement that the State Department’s move seemed “intentionally cruel.” 

“Blocking Palestinian children injured by American weapons from coming to America for medical treatment is the latest sign that the intentional cruelty of President Trump’s ‘Israel First’ administration knows no bounds,” said CAIR National Executive Director Nihad Awad.

Israel has led a brutal onslaught and near-total blockade in Gaza since October 7, 2023, following the Hamas-led terrorist attacks in Israel. More than 60,000 Palestinians have been killed in Gaza since October 7, Gaza’s Health Ministry said at the end of July. More than 50,000 children in Gaza have been killed or injured during this period, according to UNICEF, and more than one child has been killed per hour, according to The Washington Post. In April, an Israeli airstrike destroyed part of the last fully functional hospital in Gaza. Israel has tightly restricted food and humanitarian aid allowed into Gaza, creating widespread famine throughout the strip.

Trump previously called Loomer a “free spirit” when the two traveled together last September, and she continues to privately advise him and others in the administration.

After Trump won in November, various Gazan families and immigration attorneys — who were already largely sickened by the Biden administration’s actions during this conflict — were in panic mode, fearing the worst for how any slivers of relief and options they were offered under the Democratic presidency would evaporate under a second Trump government.

Those fears are being realized, and then some.

“I’ve visited with some of the children in Houston, [Texas], who have been brought here from Gaza for medical treatment,” human rights lawyer Maria Kari told Rolling Stone in January. “I’m a mother and I don’t know how many diapers you’ve changed. But until this war, I had never seen someone have to change a diaper on a baby — who was just under two years old — who had third-degree burns on the diaper-change area. The sound the baby makes is horrifying. It’s seared into your brain. It haunts you forever. I’ve sat and ate with a girl who had to hold her jaw while we ate because there’s a hole in her jaw and food was falling out while she ate. I’ve sat and painted ceramic dinosaurs with these children — the same things I do with my children — and they’re so beautiful, they’re so cute and resilient. One of them had just buried her baby sister just before she got on a plane to come here.” 

This is whom Republicans and their allies are working hard to shun, banish, and deny relief.

Washington Post: ICE crackdown imperils Afghans who aided U.S. war effort, lawyers say

Two former Afghan interpreters for U.S. forces face deportation despite following immigration processes, according to attorneys for the men.

One former interpreter for U.S. forces in Afghanistan was detained by immigration agents in Connecticut last month after he showed up for a routine green card appointment. A second was arrested in June, just minutes after attending his first asylum hearing in San Diego.

As the administration seeks to fulfill President Donald Trump’s pledge to carry out the largest deportation operation in U.S. history, attorneys for the men say their clients — Afghans who fear retribution from the Taliban for their work assisting the United States in its 20-year war in Afghanistan — have found themselves in the crosshairs of U.S. Immigration and Customs Enforcement. The attorneys provided The Washington Post with military contracts and certificates, asylum and visa applications, recommendation letters and other records that described both men’s work on behalf of U.S. forces during the war.

After Kabul fell to the Taliban in August 2021, President Joe Biden’s administration moved to resettle Afghans who had worked for the U.S. government through the Special Immigrant Visa (SIV) program, which grants lawful permanent resident status and a pathway to U.S. citizenship. As of April, about 25,000 Afghans had received an SIV, and another 160,000 had pending applications, said Adam Bates, an attorney with the International Refugee Assistance Program who analyzed State Department data.

But the Trump administration is rolling back programs created to assist more than 250,000 Afghans — including the allies who worked for U.S. forces and other refugees who fled after the Taliban takeover. And while administration officials say SIV processing will continue, advocates for Afghans who served with U.S. troops fear the curtailment of programs they depend on, along with Trump’s ambitious deportation plan, jeopardizes those still vying for SIV protection.

They point to the arrests of Zia, 36, and Sayed Naser, 33, whose attorneys argue they followed proper immigration processes. The Post agreed to withhold the last names of both men because of the ongoing threats to their lives from the Taliban.

“Zia is not an outlier,” his attorney Lauren Cundick Petersen said during a news conference last month. “We’re witnessing the deliberate redefinition of legal entry as illegal for the purpose of meeting enforcement quotas.”

Matt Zeller, an Army veteran whose Afghan interpreter saved his life in a 2008 firefight, co-founded the nonprofit No One Left Behind to help resettle Afghans. He said he fears the immigration crackdown will unwind that effort.

“The Trump administration knows what’s going to happen to these folks. They’re not stupid. They understand that the Taliban is going to kill them when they get back to Afghanistan,” Zeller said. “They just don’t care.”

In response to questions from The Post, White House spokeswoman Abigail Jackson said the administration’s top immigration enforcement priority is “arresting and removing the dangerous violent, illegal criminal aliens that Joe Biden let flood across our Southern Border — of which there are many.”

“America is safer because of President Trump’s immigration policies,” she said.

Daily Beast: ICE Memo Says Migrants Can Be Deported to Third Countries

Homeland Security Secretary Kristi [Bimbo #2] Noem confirmed the new policy in an appearance on Fox News.

Immigration and Customs Enforcement (ICE) plans to deport migrants to countries where they are not citizens and do not speak the language with as little as six hours’ notice.

Deporting people to third countries where they don’t speak the language is truly inhumane.

If they are at risk of torture or persecution in their home countries, they should be eligible for asylum in the U.S. Period.

A six-hour window in which to contact your attorney and appeal is utterly absurd.

Washington Post: Morale craters at State Department as mass layoffs loom

Secretary of State Marco Rubio has called the agency “bloated,” yet as violence spiked in the Middle East, staff say they’ve been asked to work extra hours.

The Trump administration’s plan for mass layoffs at the State Department has left much of the workforce exasperated and embittered, tanking morale as extra demands were made to assist U.S. citizens seeking to flee the Middle East amid Israel’s war with Iran, employees say.

At the direction of Secretary of State Marco Rubio, the State Department informed Congress in May that it planned to reduce its U.S. workforce by more than 15 percent — almost 2,000 people — as part of a sweeping reorganization intended to streamline what he has called a “bloated bureaucracy that stifles innovation and misallocates scarce resources.” Separately, he has accused certain bureaus within the department of pursuing a “radical political ideology.”

Rubio had set a July 1 timeline for the dismissals, but execution of the plan is contingent on a favorable ruling from the Supreme Court, which is evaluating President Donald Trump’s sweeping attempt to fire federal workers across numerous government agencies. It’s unclear when the court could act.

Amid the wait, State Department staff were asked to work additional hours to help at-risk Americans as fighting between Israel and Iran stirred fears of a full-scale regional crisis. A task force, established on June 12 to manage evacuations, faced an even greater sense of urgency after Trump directed U.S. military intervention in the conflict.
