The Street: Elon Musk faces growing legal Twitter/X problem

A lawsuit he previously filed is facing a major challenge.

With all the problems Tesla is facing, it can be easy to forget that Elon Musk is fighting other battles. He’s currently in the throes of a vicious lawsuit involving one of his other companies.

When Musk finalized his acquisition of Twitter, now called X, in October 2022, it sparked a backlash that extended beyond the platform’s users. Many people deleted their accounts in protest of Musk’s beliefs on certain topics, but some companies also took a stand against him.

In the months that followed his takeover, a large number of companies halted advertising on X amid reports of offensive content and declining user activity. This included prominent companies such as Lego, Shell, and Nestlé, to name just a few.

Musk responded with a lawsuit against these former clients, alleging that they had illegally boycotted his platform.

No, F’Elon, it’s not a boycott. Advertisers choose what platforms they advertise on based on the size, quality, characteristics of a site’s users. If the real user count drops, if the users become hostile, if the content becomes questionable, etc., advertisers may choose no longer to advertise there and seek more appropriate venues for their advertising dollars.

If you lost advertising dollars, it’s because you weren’t serving their wants and needs.

Daily Beast: Judge Arrested by Trump Administration Fights Back With Trump’s Own Immunity Case

A Milwaukee judge who was arrested for allegedly shielding an undocumented immigrant from ICE arrest has argued that she can’t be prosecuted based on the same case that granted President Donald Trump broad immunity for “official” acts.

The FBI arrested Hannah Dugan last month after she allegedly told agents with Immigration and Customs Enforcement that they needed a warrant to arrest an undocumented immigrant who had appeared in her courtroom on a misdemeanor charge.

FBI Director Kash Patel accused Dugan in a social media post of “intentionally misdirecting federal agents away” from the man, a Mexican immigrant named Eduardo Flores Ruiz who was nevertheless arrested outside the courthouse.

Dugan was indicted on Tuesday for allegedly concealing a person from arrest and obstruction. A day later, her lawyers argued in a motion to dismiss the case that Dugan is “no ordinary criminal defendant.”

The motion argued that the problems with the prosecution were “legion,” including the fact that they allegedly violated the U.S. Constitution’s fundamental principle of federalism. But “most immediately, the government cannot prosecute Judge Dugan because she is entitled to judicial immunity for her official acts,” it said.

A federal judge warned on Friday that a new executive order from President Donald Trump that calls for cutting off funding to so-called sanctuary jurisdictions that do not cooperate with his immigration agenda cannot be used to evade a court order barring his administration from doing just that.

U.S. District Judge William Orrick in San Francisco issued Friday’s order, opens new tab at the urging of 16 cities and counties nationally that had already secured an injunction barring the administration from withholding all federal funding to them.

CNBC: Trump administration ‘looking at’ suspending habeas corpus for migrants, Stephen [“Goebbels”] Miller says

  • Senior White House advisor Stephen [“Goebbels”] Miller said that the Trump administration is “actively looking at” suspending the writ of habeas corpus, the right to challenge a person’s detention by the government, for migrants.

  • The writ has only been suspended four times since the U.S. Constitution was adopted, and in all but one case, Congress first authorized that action.

White House deputy chief of staff for policy Stephen [“Goebbels”] Miller said Friday that the Trump administration is “actively looking at” suspending the writ of habeas corpus — the constitutional right to challenge in court the legality of a person’s detention by the government — for migrants.

[“Goebbels”] Miller’s comment came in response to a White House reporter who asked about President Donald Trump entertaining the idea of suspending the writ to deal with the problem of illegal immigration into the United States.

Asked when that might happen, [“Goebbels”] Miller responded: “The Constitution is clear, and that, of course, is the supreme law of the land, that the privilege of the writ of habeas corpus can be suspended in time of invasion.”

“So, I would say that’s an option we’re actively looking at,” he said.

This comes a day or two after the release of Rumeysa Öztürk, who was detained for 45 days by ICE for writing an op-ed column in a newspaper, never charged with nor convicted of any crime:

Öztürk challenged her detention with a petition for writ of habeas corpus, which noted that she “has not been charged with any crime,” and which argued that her “arrest and detention are designed to punish her speech and chill the speech of others.”

“The case ostensibly proceeds as a FOIA lawsuit, with the Trump-aligned group seeking access to judiciary records,” Kovensky explains. “But, in doing so, it asks the courts to cede massive power to the White House: the bodies that make court policy and manage the judiciary’s day-to-day operations should be considered independent agencies of the executive branch, the suit argues, giving the president, under the conservative legal movement’s theories, the power to appoint and dismiss people in key roles.”

White House Press Secretary Karoline Leavitt [Bimbo #1] refused to shut down speculation that Donald Trump could suspend due process for migrants.

Leavitt [Bimbo #1] was asked about pausing the writ of habeas corpus at a hastily announced press briefing on Monday morning focused on immigration.

Habeas corpus, which is preserved in Article I of the Constitution, is the legal process that allows the courts to review whether a person is being wrongly detained or imprisoned.

“The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it,” it reads.

The Trump administration has been accused of denying migrants due process in an effort to quickly remove them from the U.S. and has faced off with multiple judges over its mass deportation effort.

Leavitt [Bimbo #1] insisted that the administration will continue to deport undocumented immigrants.

“The president is open to all remedies to do that,” she said.
