Washington Examiner: Appellate judge blasts courts’ ‘special treatment’ for illegal immigrants

Circuit Judge James Ho issued a blistering concurrence Tuesday, taking aim at the Supreme Court and other courts’ “special treatment” for illegal immigrants in legal proceedings.

A three-judge panel on the U.S. Court of Appeals for the 5th Circuit issued an order to expedite the oral arguments of a challenge to the deportation of a group of Venezuelan nationals under the Alien Enemies Act in Texas. The order came after the Supreme Court vacated the appellate court’s previous ruling, saying it lacked jurisdiction, and denied a bid by the migrants’ lawyers to temporarily stop President Donald Trump’s administration from deporting the group of foreign nationals under the AEA.

Apparently Slo Ho didn’t appreciate the urgency of the higher court and the fact that the higher court had vacated their previous ruling for lack of jurisdiction.

Kudos for the Supreme Court’s sense of urgency. When people are being deported, they can be here today and gone tomorrow, if not sooner.

That’s hardly “special treatment for illegal immigrants”. They’re people, too.

El Paso immigration judge Michael S. Pleters was incredulous. He had expected to hear a request from Henrry Albornoz Quintero for political asylum in the U.S., but though the Venezuelan had been held by Immigration and Customs Enforcement, he was absent the day of his April hearing.

Washington Post: They were arrested during routine ICE check-ins. Then they disappeared.

Deportation proceedings are often shrouded in secrecy. But lawyers say the lack of information about the Venezuelan migrants deported under the Alien Enemies Act is nearly unprecedented.

Henrry Albornoz Quintero’s family had been tracking his whereabouts through an online detainee locator ever since he was arrested and put in deportation proceedings after a routine check-in with immigration officials in late January.

But on Friday — less than a week before the expected birth of his son — the Venezuelan man disappeared from the database.

“Your search has returned zero (0) matching records,” the government website states.

The families and lawyers of dozens of other Venezuelan and Salvadoran men who had been detained by U.S. Immigration and Customs Enforcement say their relatives and clients have similarly disappeared over the past week, with no explanation provided by the government over where they may be.

Attorney General Pam Bondi was caught skipping out of a press conference as she avoided answering a reporter’s question on migrants without criminal records sent to El Salvador….

“60 Minutes found that 75% of the immigrants who were sent to El Salvador do not have public criminal records. Is that true?” the correspondent asked as Pam Bondi stepped outside to take questions on immigration from reporters.

As part of her reply, Bimbo #3 & Airhead Extraordinaire says:

“So if you committed a murder in our country, we’re gonna keep you here and we’re gonna seek the death penalty and we’re gonna keep you in prison because our victims’ families deserve that, but we don’t have to charge them with every crime. We can deport them and get them out of our country and save room in our prisons because they should have never been in our country to begin with,” she finishes.

Which is a roundabout way of saying that the Venezuelans they’re deporting aren’t really criminals. And the reporter’s follow-up question:

The reporter continues to press her, as Bondi didn’t answer her original question. “So you confirmed they didn’t commit a crime, right?” asked the reporter.

Whereupon Bimbo #3 and Airhead Extraordinaire got flustered and stomped out:

Franken, also the former Director of the Defense POW/MIA Accounting Agency (DPAA) who served under Presidents Obama and Trump, added: “The first three Geneva Conventions dealt with combatants. The 4th with civilian prisoners. They are either combatants in MAGA minds or civilians without due process. Geneva signatory is germane.”

US Appeals Court Hands Trump Stinging Defeat in Deportation Case

In a 2-1 decision, the U.S. Court of Appeals for the District of Columbia Circuit upheld the March 15 ruling from Boasberg that temporarily halted deportations under the Alien Enemies Act after ordering that the government’s “emergency motions for stay be denied,” according to court documents reviewed by Newsweek.

Washington Post: IRS nears deal with ICE to share addresses of suspected undocumented immigrants

Looks like they are dispensing with the court approval normally required to share IRS data, which leaves the legality of the arrangement highly questionable.

This also means that any illegal alien with half a brain will no longer file tax returns nor pay any more than his required withholdings.

The Internal Revenue Service is nearing an agreement to allow immigration officials to use tax data to confirm the names and addresses of people suspected of being in the country illegally, according to four people familiar with the matter, culminating weeks of negotiations over using the tax system to support President Donald Trump’s mass deportation campaign.

Under the agreement, Immigration and Customs Enforcement could submit names and addresses of suspected undocumented immigrants to the IRS to cross-reference with confidential taxpayer databases, said the people, who spoke on the condition of anonymity out of fear of professional reprisals.

Normally, personal tax information — even an individual’s name and address — is considered confidential and closely guarded within the IRS. Unlawfully disclosing tax data carries civil and criminal penalties.

However, tax information may be shared with other federal law enforcement under certain, limited conditions — and typically with approval from a court. It would be unusual, if not unprecedented, for taxpayer privacy law exceptions to be used to justify cooperation with immigration enforcement …
