The White House violated a court order on deportations to third countries with a flight linked to the chaotic African nation of South Sudan, a federal judge said Wednesday, hours after the Trump administration said it had expelled eight immigrants convicted of violent crimes in the United States but refused to reveal where they would end up. The judge’s statement was a notably strong rebuke to the government’s attempts to manage immigration.

In an emergency hearing he called to address reports that immigrants had been sent to South Sudan, Judge Brian E. Murphy in Boston said the eight migrants aboard the plane were not given a meaningful opportunity to object that the deportation could put them in danger. Minutes before the hearing, administration officials accused “activist judges” of advocating the release of dangerous criminals.

“The department actions in this case are unquestionably in violation of this court’s order,” Murphy said Wednesday, arguing that the deportees didn’t have “meaningful opportunity” to object to being sent to South Sudan. The group was flown out of the United States just hours after getting notice, leaving them no chance to contact lawyers who could object in court.

In an important federal case in Massachusetts over whether deportees can be sent to third countries rather than their countries of origin, the Trump administration admitted Friday to a grievous error and managed to compound it in the process.

It’s a bit complicated so let me boil it down to its essentials:

  • Background: A gay Guatemalan national who had a U.S. immigration judge order barring his removal to his home country because he feared continued persecution was instead deported to Mexico in February by the Trump administration, partly on the grounds that he had told ICE that he didn’t fear being sent to Mexico. That was odd because the man, identified only by the initials O.C.G., had previously testified that he had been targeted and raped in Mexico, his lawyers say.
  • Thursday: The Trump DOJ abruptly cancelled the scheduled deposition of an ICE official “whom Defendants previously identified as giving Plaintiff O.C.G. notice of deportation to Mexico and recording his response of lack of fear,” O.C.G.’s lawyers later told the court.
  • Friday: The Trump DOJ filed a “Notice of Errata” admitting that during the judge’s ordered discovery in the case it had been unable to “identify any officer who asked O.C.G. whether he had a fear of return to Mexico.” A key factual element of the Trump administration’s case had evaporated. But it got worse …
  • Sunday: Lawyers for the deportee – who is now in hiding in Guatemala because he fears persecution as a gay man – filed an emergency motion pointing out, among other things, that the government’s filing about its own error revealed the deportees name and other information, further jeopardizing his safety despite a court order anonymizing his identifying information.

Still with me? In the course of admitting its error, the Trump administration outed the gay man who it had wrongfully deported in the first place.

Last month, President Donald Trump shared an edited image of the knuckles of Kilmar Abrego Garcia, a Maryland resident with protected status wrongfully sent to a Salvadoran detention facility. The photo showed “MS13” apparently added above his knuckle tattoos, even though other photos of his hand did not have that text. Last week, I had a chance to ask Homeland Security Security Kristi Noem [Bimbo #2] if she had investigated how an edited image came into the president’s hands. Not only did she refuse to answer, she barely acknowledged that the image was edited.

The groundwork for jailing the innocent is being laid right now — not behind closed doors, but out in the open.

First, Trump appointed Kash Patel as FBI director, an unqualified podcaster who published a book listing names of Trump’s enemies who should be imprisoned. I didn’t make the top 60; rather, I was mentioned in the foreword to Patel’s list as a legislator who should be targeted.

Next, in Trump’s first hours as president, rather than issuing executive orders that would lower consumer costs, he pardoned or commuted the sentence of every Jan. 6 criminal. A man willing to free hundreds of political allies seems more than willing to jail his political enemies.

Accordingly, last month, Trump directed his attorney general to investigate Christopher Krebs, former head of the Cybersecurity and Infrastructure Security Agency, and Miles Taylor, former chief of staff at the Department of Homeland Security. Krebs made the mistake of declaring the 2020 election the most secure in history. Taylor had the courage to organize other concerned Trump national security officials to bring to light Trump’s constitutional crimes.

And Trump demonstrated he’s willing to tell any lie to justify jailing anyone — which brings us back to Abrego Garcia. In April, the Trump administration admitted in court that it had mistakenly sent Abrego Garcia to El Salvador.

Every court that’s heard Abrego Garcia’s appeal — including the Supreme Court — has ordered Trump to facilitate his return to the United States. When asked about the case, Trump boasted he “could” return Abrego Garcia, but he “won’t.” To justify the man’s imprisonment, Trump has pointed to the altered image.

Independent: Trump endorses idea that Supreme Court ruling blocking his deportations under Alien Enemies Act is ‘illegal’

President reposted a comment claiming the Supreme Court was heading down the wrong path by blocking some of Trump’s actions

President Donald Trump endorsed the idea that the United States Supreme Court had placed an “illegal injunction” on him by temporarily blocking his administration’s ability to deport Venezuelans, accused of being gang members, without due process, while litigation on the matter plays out in lower courts.

On Truth Social on Saturday, Trump reposted two posts made by attorney Mike Davis, a close Trump ally and the founder of the Article III project, calling the court’s recent decision “illegal” and claiming it was “heading down a perilous path” by not allowing Trump to continue a constitutionally questionable action.

“The Supreme Court still has an illegal injunction on the President of the United States, preventing him from commanding military operations to expel these foreign terrorists,” Davis wrote.

Alternet: Trump admin resurrects a dissenting argument that already went before the Supreme Court — in 1898

For more than 150 years, people who were born within U.S. territory automatically received citizenship – regardless of their parents’ immigration status.

President Donald Trump’s January 2025 executive order on birthright citizenship – stating that children born in the U.S. to parents who are not in the country legally, or who are not permanent residents, cannot receive citizenship – threatens to upend this precedent.

The Supreme Court is set to hear arguments on the case on May 14, 2025.

This comes after federal judges in three cases that took place in Maryland, Massachusetts and Washington banned Trump’s order from going into effect, determining that the president cannot change or limit the Constitution by executive order.

Birthright citizenship been obvious to anyone with half a brain for a century and a half. King Donald just isn’t that bright.

Newsweek: Trump Administration Accused of Declaring ‘Fake’ Emergency By 15 States

A coalition of attorneys general across 15 states is suing the Trump administration over declaring a “national emergency” on the first day of Donald Trump‘s presidency.

On January 20, President Trump declared a “national energy emergency” via executive order, over what he claimed to be “our Nation’s inadequate energy supply.”

The attorneys general from Washington and California say this is not true, and that US energy production is actually at “an all time high.”

“Washington state filed suit today alongside 14 other states to challenge the president’s fake “energy emergency,” declared to line the pockets of Big Oil by handing out free passes to pollute our environment,” said Washington Attorney General Nick Brown on May 9.

Bloomberg: Trump Has Been Stopped By Courts More Than 200 Times

President Donald Trump’s expansive use of executive power faced at least 328 lawsuits as of May 1 — with judges halting his policies far more often than they allowed them.

Courts entered more than 200 orders stopping the administration’s actions in 128 cases, with judges sometimes ruling at multiple stages of the legal fights. Judges had allowed contested policies to go ahead in 43 cases, and hadn’t ruled yet in more than 140 others. Most cases are in the early stages, and new ones are being filed daily.

CNN: Tennessee authorities release video of Abrego Garcia at a traffic stop that officials have used to paint him as a criminal

US officials have argued the traffic stop in November 2022, during which Abrego Garcia was not detained, supports their claims that Abrego Garcia was a member of MS-13 and involved in human trafficking. The stop resulted in no charges, and there was no mention of human trafficking in the parts of the redacted report that have been made available.

Yet the 2022 traffic stop now could play into the ongoing political debate and legal standoff over Abrego Garcia, who is still in El Salvador while a federal judge demands answers and more evidence from the Trump administration.

So far in the ongoing court proceeding over his custody, his attorneys have said that the US in his 2019 immigration proceedings offered little reason to believe Abrego Garcia was tied to a gang, other than the fact he wore a Chicago Bulls hat and that a confidential informant provided a tip to authorities.

“There is no known link or association between him and the MS-13 gang,” his lawyers told the federal judge last month.

In a statement provided to CNN regarding the bodycam footage, Abrego Garcia’s attorney Simon Sandoval-Moshenberg said, his client “has been denied the most basic protections of due process—no phone call to his lawyer, no call to his wife or child, and no opportunity to be heard.”

Sandoval-Moshenberg added that “I see no evidence of a crime in this footage. But the point is not the traffic stop — it’s that Mr. Abrego Garcia deserves his day in court. Bring him back to the United States, return him before the same immigration judge who heard his case in 2019, and let him speak for himself.”

Earlier, a spokesperson for the Tennessee Highway Patrol told CNN that Abrego Garcia was flagged to federal law enforcement, “who made the decision not to detain him.”

According to a Department of Homeland Security statement released last month about the incident, federal officials released Abrego Garcia with a warning for driving with an expired license.

And today Trump’s minions are desperately grasping at straws to deport anyone and everyone they can so as to increase their deportation counts.
