Politico: Judges have a warning about Trump’s rapid deportations: Americans could be next

A fundamental promise by America’s founders — that no one should be punished by the state without a fair hearing — is under threat, a growing chorus of federal judges say.

That concept of “due process under law,” borrowed from the Magna Carta and enshrined in the Bill of Rights, is most clearly imperiled for the immigrants President Donald Trump intends to summarily deport, they say, but U.S. citizens should be wary, too.

Across the country, judges appointed by presidents of both parties — including Trump himself — are escalating warnings about what they see as an erosion of due process caused by the Trump administration’s mass deportation campaign. What started with a focus on people Trump has deemed “terrorists” and “gang members” — despite their fierce denials — could easily expand to other groups, including Americans, these judges warn.

“When the courts say due process is important, we’re not unhinged, we’re not radicals,” U.S. District Judge Ana Reyes, a Washington, D.C.-based appointee of President Joe Biden, said at a recent hearing. “We are literally trying to enforce a process embodied in probably the most significant document with respect to peoples’ rights against tyrannical government oppression. That’s what we’re doing here. Okay?”

It’s a fight that judges are increasingly casting as existential, rooted in the 5th Amendment’s guarantee that “no person shall … be deprived of life, liberty or property, without due process of law.” The word “person,” courts have noted, makes no distinction between citizens or noncitizens. The Supreme Court has long held that this fundamental promise extends to immigrants in deportation proceedings. In a 1993 opinion, Justice Antonin Scalia called that principle “well-established.”

White House Deputy Chief of Staff Stephen Miller said on Friday that the Trump administration could suspend habeas corpus to carry out deportations currently being blocked by courts.

Speaking to reporters at the White House grounds, Miller said Trump could invoke the Constitution to enforce the decision. “The Constitution, which is the supreme law of the land, is clear. It says that the privilege of the writ of habeas corpus can be suspended in a time of invasion. So it’s an option we’re actually looking at,” Miller said.

“A lot of it depends on whether the courts do the right thing or not,” Miller added. He sought to back his argument by claiming courts around the country are overreaching and undermining the two other branches of government. He has repeatedly accused judges of committing a “judicial coup” when referencing rulings he or the administration disagree with.

Reuters: Tufts student detained by US immigration authorities must be released, judge rules

A federal judge ordered the Trump administration on Friday to immediately release a Tufts University student from Turkey who has been held for over six weeks in a Louisiana immigration detention facility after she co-wrote an opinion piece criticizing her school’s response to Israel’s war in Gaza.

U.S. District Judge William Sessions during a hearing in Burlington, Vermont, granted bail to Rumeysa Ozturk, who is at the center of one of the highest-profile cases to emerge from Republican President Donald Trump’s campaign to deport pro-Palestinian activists on American campuses.

Massachusetts-based Tufts has said it plans to help provide Ozturk housing upon her release. In a statement, a university spokesperson said it hoped she would be able to rejoin its community as soon as possible to resume her doctoral studies.

When a division of Amazon considered telling consumers the truth, by posting the costs tariffs added to the price of each imported product, the mere possibility set the White House on attack mode. Trump immediately called Amazon owner Jeff Bezos, who reassured him Amazon would never do such a thing, while Karoline Leavitt accused Bezos of a “political and hostile” act just for thinking about it.

When a presidential team of incompetent egoists calls truth-telling a “hostile act,” we’re in trouble.

“The case ostensibly proceeds as a FOIA lawsuit, with the Trump-aligned group seeking access to judiciary records,” Kovensky explains. “But, in doing so, it asks the courts to cede massive power to the White House: the bodies that make court policy and manage the judiciary’s day-to-day operations should be considered independent agencies of the executive branch, the suit argues, giving the president, under the conservative legal movement’s theories, the power to appoint and dismiss people in key roles.”

BBC: Tariffs on car parts entering the US come into force

A 25% import tax on engines, transmissions and other key car parts has come into force in the US, raising pressure on an industry finding its way through a thicket of policy changes.

The US president has said the new tariff, along with a 25% import tax on cars that went into effect last month, is intended to push carmakers to do more manufacturing in the US.

But analysts said any immediate expansions in the US were likely to come at the expense of production elsewhere, while also leading to higher costs for the businesses – and ultimately higher prices for customers.

“American made” cars still rely on foreign-made parts — we’re screwed by these tariffs either way.

Kansas City Star: Trump Insults CNN Reporter For ‘Hating’ America

President Donald Trump met with El Salvador President Nayib Bukele in the Oval Office to discuss Kilmar Abrego Garcia, a Salvadoran national wrongly deported to El Salvador’s CECO prison complex. The administration called Abrego Garcia’s removal an administrative error. A Supreme Court ruling declared his deportation illegal and ordered the administration to help him return to the U.S.

During the meeting, CNN anchor Kaitlan Collins asked both leaders about the process for Abrego Garcia’s return. When Collins pressed for details, Trump shifted focus to insult her, calling her “low-rated” and saying CNN “hates our country.”
